Suren: GTF seek lasting peace within an undivided Sri Lanka.

Chennai: Global Tamil Forum spokesperson and its director of strategic initiatives, Suren Surendiran, presently in Chennai on a private visit, speaks about the Sri Lankan Tamils gaining new hope from change of regime in Delhi.
Excerpts:
Q: The TNA recently met Indian PM Narendra Modi. How do you view this development?
Suren Surendiran: Global Tamil Forum (GTF) believes that Mr Modi meeting TNA members, who are the democratically elected representatives of Tamils in Sri Lanka, is a significant step. On the day after his taking charge as PM, Mr Modi had met President Rajapaksa, who was an invited guest at his inauguration event. However, before meeting a formal Sri Lanka’s government delegation or the official opposition party in Sri Lankan Parliament, PM Modi choosing to meet the TNA underscores the significance.
Regarding subsequent events, Rajapaksa has maintained status quo. He has not made any efforts to engage the TNA in any constructive way. The large military presence still continues in the Tamil-dominated north and east. Land-grabbing and government-sponsored colonisation of the Tamil areas with the clear intent to change the demography is still continuing. Vulnerable women, mostly the 80,000 or more Tamil war widows in the north and east, are being harassed and subjected to sexual violence, largely by the Sinhala military.
Q: What will the efforts towards success in the Sri Lankan Tamil issue look like, say about 18 months from now? And what would be the impact if these efforts fail to yield fruit?
Suren: The Indian foreign policy towards Sri Lanka corrects its course and takes more of a regional leadership role than being the subdued equal partner role. In this process, India uses all levers at her disposal with specific timelines set to achieve lasting peace in the region. India and the international community maintain pressure on Rajapaksa to deliver on his promises and articulate consequences for non-delivery.
Tamil leadership in the north/east and around the country, including the plantation workers and the leadership of the Tamil-speaking Muslims should find convergence on the important issues faced by their communities. The same should be achieved with the like-minded Sinhala Buddhists and Christians. While Tamil diaspora is accepted as a stakeholder by most of the international community, India’s recognition will be fundamentally important to strengthen the moderate voices within the diaspora. This, in turn, will broaden the stakeholder base that can add capacity and capability to the struggle, in the most constructive way.
Failure would mean that Rajapaksa continues as the hawkish President with a corrupt regime persecuting minorities. Allowing this would create rebellious forces from several communities and that will not just destabilise Sri Lanka but the entire region.
Q: LTTE chief Velupillai Prabhakaran was the sole voice representing the Tamil people of Sri Lanka until his death in May 2009. Now the Tamil voice not only sounds weak but also is badly divided.
Suren: The TNA, the elected representatives of the Tamil people in the island, and the GTF that is an umbrella body in the diaspora with significant influence and contacts with several international bodies and governments, work in conjunction. There has been a programme run by the several representative bodies to consolidate even further, which work is in progress. TNA has also taken steps to explore possibilities of convergence with the leadership of Tamil-speaking Muslims in the island. I am more positive about my community than less!
Q: Should the Tamils continue to insist on separate Eelam or work towards something that might be more realistic in achieving, such as the 13th Amendment as a starting point?
Suren: GTF is committed to non-violence. We seek lasting peace in Sri Lanka, based on justice, reconciliation and negotiated political settlement within an undivided island of Sri Lanka.
Q: Considering the Chinese interest and involvement in Sri Lanka, what, according to you, should be the Indian agenda in the strategically important southern neighbour?
Suren: India should at least now, take a regional leadership role to assert her policy on strategic and national security priorities. The lack of it may leave India a larger and unnecessarily wider issue to deal with in the near future.

The Tamil United Liberation Front (TULF) Secretary General V. Anadansangaree in a letter to Indian Prime Minister Narendra Modi this week said the TNA and the ITAK by supporting the activities of the LTTE should take responsibility for innumerable crimes that had resulted in the deaths of thousands.
“Innumerable crimes had been committed resulting in the death of thousands, some of whom were Members of Parliament. According to the TNA’s manifesto of 2004, the TNA and ITAK should accept responsibility for these crimes,” Mr. Anandasangaree said in the letter.
In reference to the TNA’s relationship with the LTTE , Mr. Anandasangaree alleged that ahead of the 2004 Parliamentary elections, representatives of the ITAK, ACTC, TELO and the EPRLF signed a declaration accepting the “leadership of the LTTE as the National Leadership of the Tamil people and also accepting the LTTE as the real sole representatives of the Tamil people.” They also pledged “to give our full support for the struggle the LTTE had undertaken on behalf of the Tamil Nation”.
He said the declaration of the four secretaries of the alliance gave ample opportunities for the LTTE to commit atrocious crimes between April 2004 and May 18, 2009. The TULF General Secretary urged the Indian Prime Minister to consult other Tamil political parties and Tamil-speaking people of Sri Lanka and not exclusively the Tamil National Alliance (TNA).
“Dealing with the Tamil question is no more a monopoly of either the TNA or the Illankai Tamil Arasu Kachchi (ITAK). Having waited so long by allowing the TNA to deal with our ethnic problem and having lost confidence in the TNA, the time has now come for all the other concerned parties to find an alternative,” V. Anandasangaree said in a letter to Mr. Modi this week.
Mr. Anandasangaree said the TNA was supposed to comprise five political parties — the ITAK, TELO, EPRLF, TULF and the PLOTE – but the delegation which met Modi comprised only four members from the ITAK and one each from the TELO and EPRLF with none from the PLOTE although its leader polled more than 40,000 votes and came third at the recently held Northern Provincial Council elections.
He added that the claim of the TNA that voters had repeatedly given it the mandate through various elections, to negotiate with the Government was not acceptable and misleading. “The 2004 general election was virtually conducted by the LTTE with little or no supervision by the Government. There was large scale impersonation, threats and intimidation of voters by the LTTE and some won after their defeats were announced.”
Mr. Anandasangaree said the Indian Prime Minister’s advice must be taken seriously if the Tamils in Sri Lanka wanted a solution. “Hence action should be taken forthwith to consult various political parties of Tamils and Tamil-speaking people to know their views. The intention of meeting the party leaders is not to confront any one of them including the TNA and the ITAK, who should be warned of their links with the LTTE if they are serious in finding solutions. The sole purpose is to arrive at a consensus and to see to what extent we can compromise,” he said.

Just as the US admitted shortly after the so-called “Arab Spring” began spreading chaos across the Middle East that it had fully funded, trained, and equipped both mob leaders and heavily armed terrorists years in advance, it is now admitted that the US State Department through a myriad of organizations and NGOs is behind the so-called “Occupy Central” protests in Hong Kong.
The Washington Post would report in an article titled, “Hong Kong erupts even as China tightens screws on civil society,” that:
Chinese leaders unnerved by protests elsewhere this year have been steadily tightening controls over civic organizations on the mainland suspected of carrying out the work of foreign powers.
The campaign aims to insulate China from subversive Western ideas such as democracy and freedom of expression, and from the influence, specifically, of U.S. groups that may be trying to promote those values here, experts say. That campaign is long-standing, but it has been prosecuted with renewed vigor under President Xi Jinping, especially after the overthrow of Ukrainian President Viktor Yanukovych following months of street demonstrations in Kiev that were viewed here as explicitly backed by the West.
The Washington Post would also report (emphasis added):
One foreign policy expert, who spoke on the condition of anonymity to discuss a sensitive subject, said Putin had called Xi to share his concern about the West’s role in Ukraine. Those concerns appear to have filtered down into conversations held over cups of tea in China, according to civil society group members.
“They are very concerned about Color Revolutions, they are very concerned about what is going on in Ukraine,” said the international NGO manager, whose organization is partly financed by the National Endowment for Democracy (NED), blamed here for supporting the protests in Kiev’s central Maidan square. “They say, ‘Your money is coming from the same people. Clearly you want to overthrow China.’ ”
Congressionally funded with the explicit goal of promoting democracy abroad, NED has long been viewed with suspicion or hostility by the authorities here. But the net of suspicion has widened to encompass such U.S. groups as the Ford Foundation, the International Republican Institute, the Carter Center and the Asia Foundation.
Of course, NED and its many subsidiaries including the International Republican Institute and the National Democratic Institute do no such thing as “promoting democracy,” and instead are in the business of constructing a global network of neo-imperial administration termed “civil society” that interlocks with the West’s many so-called “international institutions” which in turn are completely controlled by interests in Washington, upon Wall Street, and in the cities of London and Brussels.
The very concept of the United States ”promoting democracy” is scandalous when considering it is embroiled in an invasive global surveillance scandal, guilty of persecuting one unpopular war after another around the planet against the will of its own people and based on verified lies, and brutalizing and abusing its own citizens at home with militarized police cracking down on civilians in towns like Ferguson, Missouri – making China’s police actions against “Occupy Central” protesters pale in comparison. “Promoting democracy” is clearly cover for simply expanding its hegemonic agenda far beyond its borders and at the expense of national sovereignty for all subjected to it, including Americans themselves.
In 2011, similar revelations were made public of the US’ meddling in the so-called “Arab Spring” when the New York Times would report in an article titled, “U.S. Groups Helped Nurture Arab Uprisings,” that:
A number of the groups and individuals directly involved in the revolts and reforms sweeping the region, including the April 6 Youth Movement in Egypt, the Bahrain Center for Human Rights and grass-roots activists like Entsar Qadhi, a youth leader in Yemen, received training and financing from groups like the International Republican Institute, the National Democratic Institute and Freedom House, a nonprofit human rights organization based in Washington.
The article would also add, regarding NED specifically, that:
The Republican and Democratic institutes are loosely affiliated with the Republican and Democratic Parties. They were created by Congress and are financed through the National Endowment for Democracy, which was set up in 1983 to channel grants for promoting democracy in developing nations. The National Endowment receives about $100 million annually from Congress. Freedom House also gets the bulk of its money from the American government, mainly from the State Department.

Pro-war and interventionist US Senator John McCain had famously taunted both Russia’s President Vladimir Putin and President Xi Jinping’s predecessor in 2011 that the US subversion sweeping the Middle East was soon headed toward Moscow and Beijing. The Atlantic in a 2011 article titled, “The Arab Spring: ‘A Virus That Will Attack Moscow and Beijing’,” would report that:
He [McCain] said, “A year ago, Ben-Ali and Gaddafi were not in power. Assad won’t be in power this time next year. This Arab Spring is a virus that will attack Moscow and Beijing.” McCain then walked off the stage.
Considering the overt foreign-funded nature of not only the “Arab Spring,” but now “Occupy Central,” and considering the chaos, death, destabilization, and collapse suffered by victims of previous US subversion, “Occupy Central” can be painted in a new light – a mob of dupes being used to destroy their own home – all while abusing the principles of “democracy” behind which is couched an insidious, diametrically opposed foreign imposed tyranny driven by immense, global spanning corporate-financier interests that fear and actively destroy competition. In particular, this global hegemon seeks to suppress the reemergence of Russia as a global power, and prevent the rise of China itself upon the world’s stage.
The regressive agenda of “Occupy Central’s” US-backed leadership, and their shameless exploitation of the good intentions of the many young people ensnared by their gimmicks, poses a threat in reality every bit as dangerous as the “threat” they claim Beijing poses to the island of Hong Kong and its people. Hopefully the people of China, and the many people around the world looking on as “Occupy Central” unfolds, will realize this foreign-driven gambit and stop it before it exacts the heavy toll it has on nations that have fallen victim to it before – Libya, Syria, Ukraine, Egypt, and many others.

Timing of Jayalalithaa case targets Dravidian polity

Tamil Nadu Chief Minister and AIADMK Chief Ms J Jayalalithaa has been sentenced on Saturday to 4 years of imprisonment, Rs. 100 crore fine and has been debarred from contesting elections for six years after the completion of the prison term by a special court of India, in a 18-year-old disproportionate assets case. Last month, New Delhi’s Central Bureau of Investigation filed a new telecommunication corruption case against a former DMK minister and a Malaysian corporate owner of Eezham Tamil origin, in addition to earlier cases on DMK leaders. The New Delhi government stridently opposes and blocks any UN or international scrutiny on crimes committed in the island of Sri Lanka. Ms Jayalalithaa, personally as well as through Tamil Nadu State Assembly, has been demanding international investigations on the genocide in the island.
The timing of the judicial measures, politically and geopolitically targets Dravidian polity in Tamil Nadu that challenges the ‘Hindutva’ polity’s imperialist vision, which doesn’t shun complicity in the genocide of Eezham Tamils, political observers in Chennai said.
New Delhi’s partnership with Colombo in the genocidal-military engineering in the region is the core factor behind the unfolding developments related to Tamil Nadu, the observers further said.
Citing political unrest in Tamil Nadu following the court verdict on Saturday, BJP’s Strategic Action Committee chairman Subramanian Swamy, who had originally filed the case against Ms Jayalalithaa in 1996, has already started demanding dismissal of the Tamil Nadu government and ‘presidential rule’ in the State.
While individual misappropriation of public funds are heard, decided, publicized and used, en bloc misappropriation of the lands and resources of the whole nation of Eezham Tamils takes place by the larger designs of the New Delhi Establishment. New Delhi's approach to Tamil Nadu is no more ‘national’. It is international imperialistic and geopolitical. The Tamil Nadu polity has to be awakened to the larger realities and should respond in intelligent ways, the political observers in Chennai said.

Further observations by a political analyst in Chennai follow:
The Dravidian movement had emerged as a counter-hegemonic force in Tamil Nadu politics in the early 20th century, where its foundational leaders had challenged the Indian nationalist movement for being North Indian centric and for upholding Brahminism both in society and politics.
One of the most important historic leaders of this movement, Periyar, who was a staunch anti-caste and pro-women’s rights activist, was of the opinion from the 1920’s that a separate state of Dravida Nadu alone could guarantee rights for the Tamils in the mainland.
However, the demand for a separate state was dropped by DMK, which split from the Periyar’s Dravidar Kazhagam in 1949 to become a political party. The DMK, led by CN Annadurai (Anna), focused more on having more political and cultural autonomy for the state of Tamil Nadu.
After Anna was elected as Chief Minister in 1967, the state rule has alternated only between Dravidian parties - the DMK led by Karunanidhi following Anna’s death, and the AIADMK led by MGR and later by Jayalalitha.
Several Indian academics have conceded to the Dravidian rule that the alternating governments, with their policy of competitive populism and socio-economic welfare schemes, have contributed to making Tamil Nadu one of the model states in India.
Yet, at several occasions in the past, the centre has used its powers to dismiss governments in Tamil Nadu if the state’s rulers did not comply with the centre’s line.
Likewise, this is not the first time that corruption charges against the Dravidian parties have been laid. Indian-centric media, both ‘left-wing’ and ‘right-wing’, have for several years tried to paint the Dravidian rule as essentially corrupt.
However, the recent judicial moves against Dravidian leaders have a larger and more insidious agenda.
This particular case against Jayalalitha was filed by Subramaniam Swamy in 1996. Swamy, a high ranking member in the BJP which currently rules the central government, has also clashed with the AIADMK leader recently on the issue of Tamil fishermen being shot by the Sri Lanka Navy.
He has also called for dismissal of the Tamil Nadu government citing Jayalalitha’s opposition to Sri Lanka.
While Jayalalitha was initially opposed to the political demands of the Eezham Tamil people, one of her campaign slogans in the run-up to the 2011 elections was support for free Tamil Eelam.
After she came to power, historically significant resolutions were passed in the Tamil Nadu state assembly, calling for an independent international investigation into Sri Lanka’s genocidal crimes and for a referendum to be conducted among Eezham Tamils to decide their political future.
These moves irked Delhi-centric politicians and political pundits, with many expressing the opinion that a state government cannot interfere in foreign policy, which, according to them, was a preserve of the centre.
It also needs to be noted that the India has blocked even the minimal investigations that the UN has recently commissioned. Likewise, the extent of the role of Indian officials in the war is yet to be properly investigated.
The war on the Eezham Tamil nation was facilitated by the world powers in general, specifically the Washington-New Delhi axis, owing to the geo-political significance of the region.
The same logic of these imperialisms recognizes the role that Tamil Nadu can play in the future in significantly shaping and maybe even securing political justice for the Eezham Tamils.
The targeting of strong leaders in the Tamil Nadu state, the assault on civil and political liberties, the creation of a security or corruption paranoia by the Indian media, the calls by Hindutva extremists to impose President’s rule, all have to be seen in the light of New Delhi’s attempts to break the morale of the Tamil people.

அதிமுக தலைவரும், முன்னாள் தமிழக முதல்வருமான ஜெயலிதாவை விமர்சனம் செய்ய இங்கே எந்த ஒரு அரசியல்வாதிக்கும் யோக்கியதை இல்லை. குறிப்பாக ஊழல், குடும்ப ஆட்சி, வீண் விரயம், அதிகார துஷ்பிரயோகம், எதிரணியினர் மீது வன்முறை, ஊடக அடக்கு முறை, மனித உரிமை மீறல், சட்ட ஆட்சி இன்மை, சொந்த வயிற்றுப்பாடு தேவைக்காக சொந்த மக்களையே விற்று சாப்பிடும் அரசியல் ஆகியவற்றில் உலக சாதனை செய்துள்ள இந்த வெட்கங்கெட்ட அரசாங்கத்தில் அங்கம் வகிக்கும் ஜாதிக ஹெல உறுமய போன்ற கட்சிகளுக்கு கொஞ்சமும் அருகதை இல்லை.
அதிமுக தலைவர் ஜெயலிதாவை பார்த்து எள்ளி நகையாடவும், சாபமிடவும் இங்கே உள்ள சில அரசாங்க எலிகள் கிளம்பியுள்ளதை பார்க்கும் போது விசித்திரமாக இருக்கின்றது. ஜெயலலிதா எட்டு கோடி மக்களின் முதலமைச்சர் என்பதையும், தமிழக மக்களின் அறுதி பெரும்பான்மை வாக்குகளை பெற்றுக்கொண்டுள்ள, இந்திய நாடாளுமன்றத்தின் மூன்றாவது பெரிய கட்சியின் தலைவர் என்பதையும் இந்த எலிகளுக்கு நான் ஞாபகமூட்டுக்கின்றேன்.
முன்னாள் தமிழக முதல்வர் தவறு இழைத்துள்ளாரா, இல்லையா என்பது பற்றி இந்திய நீதித்துறை தீர்மானிக்கட்டும். நீதித்துறைக்கு முகங்கொடுக்க அதிமுக சட்டபிரிவு, பிரபல இந்திய சட்ட அறிஞர் ராம் ஜெத்மலானி தலைமையில் அணி திரண்டுள்ளது. அதை அவர்கள் பார்த்துக்கொள்வார்கள் என ஜனநாயக மக்கள் முன்னணியின் தலைவர் மனோ கணேசன் தெரிவித்தார்.
அதிகாரத்தை பகிர்ந்து ஐக்கியப்படும் இயக்கத்தின் ஊடக மாநாடு இன்று புதன்கிழமை கொழும்பில் இடம்பெற்றது. இம்மாநாட்டில் சிங்கள, தமிழ் மொழிகளில் உரையாற்றிய மனோ கணேசன் மேலும் கூறியதாவது,
உலகம் ஒரு மத பயங்கரவாதியாக அடையாளம் கண்டுள்ள சர்ச்சைக்குரிய மியான்மார் நாட்டு மத தலைவர் விராது தேரரை இன்று இந்த நாட்டுக்குள்ளே சர்வ மரியாதைகளுடன் அழைத்து வருகிறீர்கள். இந்த நாட்டின் பொதுபல சேனை அடிப்படைவாத அமைப்பு, விராது தேரரின் 969 என்ற அடிப்படைவாத அமைப்புடன் ஒப்பந்தம் செய்து, ஆவணங்களை பரிமாறிக்கொள்கின்றது. அந்த மாநாட்டில் பல இனங்கள் வாழும் இலங்கையின் பன்மை தன்மையை குழப்பி விடும் முகமாக, இலங்கையின் பெயரை சிங்ஹலே என மாற்றவேண்டும் என்றும், இங்கு வாழும் மக்களை சிங்ஹல–பெளத்தர்கள், சிங்ஹல-தமிழர்கள், சிங்ஹல-இந்துகள், சிங்ஹல-முஸ்லிம்கள், சிங்ஹல-கிறிஸ்தவர்கள் என அழைக்க வேண்டும் என்றும், தேசியக்கொடியை இன்னமும் சிங்கள பெளத்த மயமாக்க வேண்டும் எனவும் கருத்துகள் கூறப்படுகின்றன.
வெளிநாட்டு விராது தேரின் ஆலோசனைகளின்படி நமது நாட்டில் நடைபெறும் இவை அரசாங்கத்தின் கண்களுக்கு சட்டமீறல்களாக, குற்றங்களாக தெரியவில்லை. ஆனால்,
முன்னாள் முதல்வர் ஜெயலலிதா இலங்கை நீதிமன்றத்தில் நிறுத்தப்படவில்லை. இலங்கை மக்களின் வரிப்பணத்தை கொள்ளையடித்தார் என குற்றஞ்சாட்டப்படவில்லை. எனவே அவரைப்பற்றி கருத்து கூறுமுன் இவர்கள் தங்களை திருத்தி கொள்ள வேண்டும். மாநிலத்திலும், தேசியரீதியாகவும் பலமான ஒரு அரசியல் தலைவரையும் நீதிமன்றத்துக்கு கொண்டு செல்லும் இந்திய நீதித்துறையை பார்த்து பாடம் படிக்க வேண்டும். இலங்கையில் நீதித்துறையின் சுதந்திரத்திற்கு அரசாங்கத்தினால் ஏற்படுத்தப்பட்டுள்ள அச்சுறுத்தலை கவனத்தில் கொள்ள வேண்டும்.
அதிமுக தலைவர் ஜெயலலிதா தனது ஆட்சிகாலத்தில் இலங்கை தேசிய இனப்பிரச்சினை தொடர்பில் இலங்கை அரசுக்கு எதிரான நிலைப்பாடுகளை எடுத்திருந்தார். இதுவே இவர்களது கோபத்துக்கு காரணமாக அமைந்துள்ளது. அதிமுக தலைவர் ஜெயலலிதா அரசியலில் இருந்து அகற்றப்பட வேண்டும் என்று இவர்கள் எதிர்பார்க்கின்றார்கள். இந்த எதிர்பார்ப்பு நல்ல எண்ணம் கொண்டது இல்லை. இங்கே வாழும் தமிழருக்காக அதிகாரத்துடன் குரல் கொடுக்கும் எந்த ஒரு சக்தியும் எந்த ஒரு நாட்டிலும் , குறிப்பாக தமிழகத்தில் இருக்கக் கூடாது என்ற எண்ணமே அரசாங்கத்திற்கு உள்ளே நிலவுகின்றது.

'தமிழ்நாடு முதலமைச்சர் செல்வி ஜெயலலிதா அவர்கள் பதவியினை இழந்து சிறையில் அடைக்கப்பட்ட நிகழ்வு தமிழீழ மக்களுக்கு மிகுந்த மனவேதனையைத் தருகிறது. இவ்வாறு நாடுகடந்த தமிழீழ அரசாங்கத்தின் பிரதமர் வி.உருத்திரகுமாரன் அவர்கள் தெரிவித்துள்ளார்.
'தமிழ்நாடு முதலமைச்சர் செல்வி ஜெயலலிதா அவர்கள் மீது பெங்களுரு சிறப்பு நீதிமன்றம் 4 ஆண்டுகள் சிறைத் தண்டனையும் 100 கோடி ரூபா அபராதமும் விதித்து அளித்துள்ள தீர்ப்பின் பிரகாரம் அவர் முதல்வர் பதவியினை இழந்து சிறையில் அடைக்கப்பட்ட நிகழ்வு தமிழீழ மக்களுக்கு மிகுந்த மனவேதனையைத் தருகிறது.
இந்த நெருக்கடியான நிலையைச் சட்டரீதியாக எதிர் கொண்டு மீண்டும் தமது அரசியல் வாழ்வில் அவர் வெற்றி பெறுவார் என நாம் உறுதியாக நம்புகிறோம்' இவ்வாறு நாடுகடந்த தமிழீழ அரசாங்கத்தின் பிரதமர் வி.உருத்திரகுமாரன் அவர்கள் தெரிவித்துள்ளார்.
இது தொடர்பில் அதிமுகவின் உத்தியோகபூர்வ பத்திரிகையான நமது எம்ஜஆர் வெளியிட்டுள்ள செய்திக்குறிப்பில் தெரிவிக்கப்பட்டுள்ளதாவது,
செல்வி ஜெயலலிதா அவர்கள் 2011 ஆண்டு தமிழ்நாடு முதலமைச்சராக நான்காவது தடவை பதவியேற்ற பின்னர் ஈழத் தமிழ் மக்களுக்கு ஆதரவான, உறுதியான, துணிவான ஒரு நிலைப்பாட்டை எடுத்து வந்தவர். ஈழத் தமிழர் தேசியப் பிரச்சினையில் வரலாற்று முக்கியத்துவம் வாய்ந்த தீர்மானங்களைத் தமிழ்நாடு சட்டமன்றப் பேரவை ஒருமனதாக நிறைவேற்றக் காரணமாக இருந்தவர்.
சிங்கள இராணுவ ஆக்கிரமிப்புக்கும் அடக்குமுறைக்கும் உள்ளாகியிருக்கும் தமிழீழத் தாயக மக்களால் தமக்கான ஒரு பாதுகாப்புக் கவசமாக உணரப்பட்டவர். தமிழீழ மக்களுக்கு மட்டுமல்ல தமிழக மக்களின் வளமான எதிர்காலத்தைக் கருத்திற் கொண்டு நல்லபல திட்டங்களை நிறைவேற்றி வந்தவர்.
இத்தகையதொரு நிலையில் ஜெயலலிதா அவர்கள் தண்டனைக்குள்ளாகியிருப்பது மிகுந்த மனவேதனையைத் தருவதாக உள்ளது.
1996ம் ஆண்டில் இருந்து 18 வருடங்களாக நடைபெற்று வந்த ஜெயலலிதா அவர்கள் மேலான வழக்கின் மீது வழங்கப் பட்டுள்ள தீர்ப்பு கடுமையானதெனப் பலரும் கருதுகின்றனர்.
நீதிபதி சட்டத்தின் எல்லையைத் தாண்டி இத் தண்டனையை வழங்கியுள்ளதாக இந்தியாவின் புகழ் பெற்ற மூத்த பெரும் வழக்குரைஞரான ராம் ஜெத்மலானி அவர்கள் கண்டனம் தெரிவித்துள்ளார். 'இந்தத் தீர்ப்பினை ஜெயலலிதாவினது அரசியல் எதிரிகள் வரவேற்கக்கூடும். ஆனால் சட்ட அறிஞரான தன்னால் ஏற்க முடியாதுள்ளது' எனவும் அவர் தெரிவித்ததாக ஊடகங்கள் செய்தி வெளியிட்டுள்ளன.
மேலும் தீர்ப்பின் தருணமும் கடுமையும் இதன் பின்னால் அரசியல் காரணங்கள் இருக்கலாமோ என்ற ஐயப்பாட்டையும் சில மட்டங்களில் தோற்றுவித்துள்ளன. செல்வி ஜெயலலிதா அவர்களும் இந்தத் தீர்ப்பின் மீது உயர்நீதிமன்றத்தில் மேன்முறையீடு செய்துள்ளதாகவும் செய்திகள் தெரிவிக்கின்றன.
இந்திய நீதித்துறை இவ் வழக்கு விடயத்தில் பொறுப்பானதும் நியாயமானதுமான முறையில் செயற்படும் என்பதே எமது நம்பிக்கையாகும் என பிரதமர் வி.உருத்திரகுமாரன் அவர்கள் தெரிவித்துள்ளார் என அதிமுகவின் உத்தியோகபூர்வ பத்திரிகையான நமது எம்ஜஆர் வெளியிட்டுள்ள செய்திக்குறிப்பில் தெரிவிக்கப்பட்டுள்ளது .

இந்த மாநிலத்தை தமது கைக்குள் கொண்டுவருவது எப்படி என்ற திட்டத்தின் ஒரு படியே செல்வி ஜெயலலிதா மற்றும் அவருடன் நெருக்கிய உறவில் இருந்தவர்களுக்கு அளிக்கப்பட தண்டனை.
ஜனநாயக கோட்பாட்டின் படி அந்த மாநிலத்தின் மக்களின் மாநில சபை ஆகட்டும் மத்திய சபை ஆகட்டும் அதிக விருப்பவாக்குக்களை பெற்று, ஆட்சியில் இருக்கும் ஒருவரை,வெறும் ஒரு சில நீதிபதிகளின் விருப்பத்தில் அவரை ஆட்சி பீடத்தில் இருந்து நீக்குவது எப்படி என்று தெரியவில்லை.
அண்ணா ஹசாரே டெல்லியில் இந்தியாவில் சகல அரச - சட்ட மட்டத்தில் புறையோடி இருக்கும் ஊழலுக்கு எதிராக உண்ணாவிரதம் இருந்த போது, அந்த ஊழல் வட இந்திய அரச மட்டத்தில் தான் அதிகம் இருந்ததால் அந்த உண்ணாவிரதத்தில் ஈடுபட்டார், ஆனால் இதில் தண்டிக்கப்பட்டு சிறை வைக்கப்பட்டு இருக்கும் ஒரு சிலரை பார்த்தால், அரசில் நோக்கத்திற்காக கட்சி நோக்கத்திற்காக சிறை வைக்கப்பட்டவர்கள் அதிகம். அண்ணா ஹசாரே உண்ணாவிரதம் இருந்த போது திரண்டு எழுந்தது வட மாநிலங்களே அதிகம், காரணம் இந்த மாநிலங்களில் தான் ஊழல் பல மட்டங்களில் புறை ஓடிக்கொண்டு இருந்தது.
அதற்காக தமிழகத்தில் ஊழல் இல்லை என்று கூறவில்லை, ஆனால் இந்த விடயத்தில் தண்டனை அளிப்பதிலும் கூட அரசியல், தேர்தல் நோக்கம் தான் முன்னிற்கிறது என்பதை வலியுறுத்த வேண்டி இருக்கிறது.
இன்று வட இந்திய அரசியலில் இருப்பவர்கள் எல்லோரையும் எடுத்து பார்த்தால் - அவர்களின் ஆரம்ப வாழ்க்கைக்கும் - இன்று வாழும் வாழ்க்கைக்கும் வித்தியாசம் இருக்கும். மண்ணில் இருந்து வானத்தை எவ்வாறு திடீரென்று தொடார்கள் என்பது கேள்விக்குறி.
இன்று முக்கியமாக அடுத்த பேசப்படும் 2 ஜி விவகாரத்தை எடுத்து பார்த்தால் - தமிழக முக்கிய கட்சியாகத் தான் இருக்கிறது. இந்த விவகாரத்தில் பங்குதாரர் ஆக இருந்ததாக கூறப்பட்டும் அல்லியான்ஸ், அல்லது டாடா போன்ற நிறுவனங்களை பற்றி அதிகமாக பேசப்படுவதாக தெரியவில்லை.
அடுத்து இன்று தண்டிக்கப்பட்டு இருக்கும் செல்வி ஜெயலலிதா அவர்கள் வெறும் கையேடு அரசியலுக்கு வந்தவர் அல்ல, அவர் தென் இந்திய சினிமாத் துறையை உச்சத்தில் இருக்கும் போது அரசியலுக்கு வந்தவர் என்பதை எல்லோரும் புரிந்து கொள்வீர்கள், ஆகவே அவர் சொத்து குவித்தார் என்பது மிகப்பெரிய கேள்வியாக இருக்கிறது- இது நம்பக்கூடியதாக இல்லை.
தமிழகத்தில் நடைபெறும் அரசியல் பழிவாங்கலின் எதிரொலி தான் இதே வொளியே வேறு எதுவும் இல்லை.
இதை வட இந்திய அரசியல் கட்சிகள் தமிழகத்தை ஆக்கிரமிக்கும் நோக்கத்துடன் பயன்படுத்துகின்றன என்பது தான் நாம் எல்லோரும் புரிந்து கொள்ளவேண்டும்.
இதை தமிழ் உணர்வாளர்கள் புரிந்து கொள்ளவார்கள் என்பதை நாம் உணர்கிறோம், அதை விட்டு விட்டு இதன் மூலம் ஆரசியல் லாபம் அடைபவர்கள், அடைய நினைபவர்கள், மக்கள் மனத்தில் உயர்ந்த இடத்தில் இருக்க மாட்டார்கள்.
ஈழத் தமிழர்களுக்கு, ஈழத் தமிழர் விடுதலைக்காக, தூக்கு தண்டனை கைதுகளுக்கு எதிராக செல்வி ஜெயலலிதா கொடுத்த குரல், மாநில அவை தீர்மானங்கள் அவர் செய்த முயற்சிகள், தமிழ் பாதுகாப்புக்கு சமஸ்கரித்த மொழி இந்தி மொழி திணிப்புக்கு எதிராக கொடுத்த கொடுத்துகொண்டிருந்த குரல் செல்வி ஜெயலலிதாவுக்கு எதிராக அளிக்கப்பட தண்டனை இட்டு ஈழத் தமிழர்கள் நாம் மிகவும் அதிர்ச்சியுடன் பார்த்தாலும், இதன் பின்னால அரசில் பின்னணி இருப்பதாகவே பார்க்கிறோம்.
இவர் விரைவில் விடுதலை செய்யப்பட வேண்டும் - தமிழகத்தில் அண்ணா திராவிட முன்னேற்ற கழகம் தொடர்ந்து மக்கள் நலனை பாதுகாக்க வேண்டும் என்பதே எமது விண்ணப்பம்.

Tamil Nadu Chief Minister and AIADMK Chief Ms J Jayalalithaa has been sentenced on Saturday to 4 years of imprisonment, Rs. 100 crore fine and has been debarred from contesting elections for six years after the completion of the prison term by a special court of India, in a 18-year-old disproportionate assets case. Last month, New Delhi’s Central Bureau of Investigation filed a new telecommunication corruption case against a former DMK minister and a Malaysian corporate owner of Eezham Tamil origin, in addition to earlier cases on DMK leaders. The New Delhi government stridently opposes and blocks any UN or international scrutiny on crimes committed in the island of Sri Lanka. Ms Jayalalithaa, personally as well as through Tamil Nadu State Assembly, has been demanding international investigations on the genocide in the island.
The timing of the judicial measures, politically and geopolitically targets Dravidian polity in Tamil Nadu that challenges the ‘Hindutva’ polity’s imperialist vision, which doesn’t shun complicity in the genocide of Eezham Tamils, political observers in Chennai said.
New Delhi’s partnership with Colombo in the genocidal-military engineering in the region is the core factor behind the unfolding developments related to Tamil Nadu, the observers further said.
Citing political unrest in Tamil Nadu following the court verdict on Saturday, BJP’s Strategic Action Committee chairman Subramanian Swamy, who had originally filed the case against Ms Jayalalithaa in 1996, has already started demanding dismissal of the Tamil Nadu government and ‘presidential rule’ in the State.
While individual misappropriation of public funds are heard, decided, publicized and used, en bloc misappropriation of the lands and resources of the whole nation of Eezham Tamils takes place by the larger designs of the New Delhi Establishment. New Delhi's approach to Tamil Nadu is no more ‘national’. It is international imperialistic and geopolitical. The Tamil Nadu polity has to be awakened to the larger realities and should respond in intelligent ways, the political observers in Chennai said.

Further observations by a political analyst in Chennai follow:
The Dravidian movement had emerged as a counter-hegemonic force in Tamil Nadu politics in the early 20th century, where its foundational leaders had challenged the Indian nationalist movement for being North Indian centric and for upholding Brahminism both in society and politics.
One of the most important historic leaders of this movement, Periyar, who was a staunch anti-caste and pro-women’s rights activist, was of the opinion from the 1920’s that a separate state of Dravida Nadu alone could guarantee rights for the Tamils in the mainland.
However, the demand for a separate state was dropped by DMK, which split from the Periyar’s Dravidar Kazhagam in 1949 to become a political party. The DMK, led by CN Annadurai (Anna), focused more on having more political and cultural autonomy for the state of Tamil Nadu.
After Anna was elected as Chief Minister in 1967, the state rule has alternated only between Dravidian parties - the DMK led by Karunanidhi following Anna’s death, and the AIADMK led by MGR and later by Jayalalitha.
Several Indian academics have conceded to the Dravidian rule that the alternating governments, with their policy of competitive populism and socio-economic welfare schemes, have contributed to making Tamil Nadu one of the model states in India.
Yet, at several occasions in the past, the centre has used its powers to dismiss governments in Tamil Nadu if the state’s rulers did not comply with the centre’s line.
Likewise, this is not the first time that corruption charges against the Dravidian parties have been laid. Indian-centric media, both ‘left-wing’ and ‘right-wing’, have for several years tried to paint the Dravidian rule as essentially corrupt.
However, the recent judicial moves against Dravidian leaders have a larger and more insidious agenda.
This particular case against Jayalalitha was filed by Subramaniam Swamy in 1996. Swamy, a high ranking member in the BJP which currently rules the central government, has also clashed with the AIADMK leader recently on the issue of Tamil fishermen being shot by the Sri Lanka Navy.
He has also called for dismissal of the Tamil Nadu government citing Jayalalitha’s opposition to Sri Lanka.
While Jayalalitha was initially opposed to the political demands of the Eezham Tamil people, one of her campaign slogans in the run-up to the 2011 elections was support for free Tamil Eelam.
After she came to power, historically significant resolutions were passed in the Tamil Nadu state assembly, calling for an independent international investigation into Sri Lanka’s genocidal crimes and for a referendum to be conducted among Eezham Tamils to decide their political future.
These moves irked Delhi-centric politicians and political pundits, with many expressing the opinion that a state government cannot interfere in foreign policy, which, according to them, was a preserve of the centre.
It also needs to be noted that the India has blocked even the minimal investigations that the UN has recently commissioned. Likewise, the extent of the role of Indian officials in the war is yet to be properly investigated.
The war on the Eezham Tamil nation was facilitated by the world powers in general, specifically the Washington-New Delhi axis, owing to the geo-political significance of the region.
The same logic of these imperialisms recognizes the role that Tamil Nadu can play in the future in significantly shaping and maybe even securing political justice for the Eezham Tamils.
The targeting of strong leaders in the Tamil Nadu state, the assault on civil and political liberties, the creation of a security or corruption paranoia by the Indian media, the calls by Hindutva extremists to impose President’s rule, all have to be seen in the light of New Delhi’s attempts to break the morale of the Tamil people.

அதிமுக தலைவரும், முன்னாள் தமிழக முதல்வருமான ஜெயலிதாவை விமர்சனம் செய்ய இங்கே எந்த ஒரு அரசியல்வாதிக்கும் யோக்கியதை இல்லை. குறிப்பாக ஊழல், குடும்ப ஆட்சி, வீண் விரயம், அதிகார துஷ்பிரயோகம், எதிரணியினர் மீது வன்முறை, ஊடக அடக்கு முறை, மனித உரிமை மீறல், சட்ட ஆட்சி இன்மை, சொந்த வயிற்றுப்பாடு தேவைக்காக சொந்த மக்களையே விற்று சாப்பிடும் அரசியல் ஆகியவற்றில் உலக சாதனை செய்துள்ள இந்த வெட்கங்கெட்ட அரசாங்கத்தில் அங்கம் வகிக்கும் ஜாதிக ஹெல உறுமய போன்ற கட்சிகளுக்கு கொஞ்சமும் அருகதை இல்லை.
அதிமுக தலைவர் ஜெயலிதாவை பார்த்து எள்ளி நகையாடவும், சாபமிடவும் இங்கே உள்ள சில அரசாங்க எலிகள் கிளம்பியுள்ளதை பார்க்கும் போது விசித்திரமாக இருக்கின்றது. ஜெயலலிதா எட்டு கோடி மக்களின் முதலமைச்சர் என்பதையும், தமிழக மக்களின் அறுதி பெரும்பான்மை வாக்குகளை பெற்றுக்கொண்டுள்ள, இந்திய நாடாளுமன்றத்தின் மூன்றாவது பெரிய கட்சியின் தலைவர் என்பதையும் இந்த எலிகளுக்கு நான் ஞாபகமூட்டுக்கின்றேன்.
முன்னாள் தமிழக முதல்வர் தவறு இழைத்துள்ளாரா, இல்லையா என்பது பற்றி இந்திய நீதித்துறை தீர்மானிக்கட்டும். நீதித்துறைக்கு முகங்கொடுக்க அதிமுக சட்டபிரிவு, பிரபல இந்திய சட்ட அறிஞர் ராம் ஜெத்மலானி தலைமையில் அணி திரண்டுள்ளது. அதை அவர்கள் பார்த்துக்கொள்வார்கள் என ஜனநாயக மக்கள் முன்னணியின் தலைவர் மனோ கணேசன் தெரிவித்தார்.
அதிகாரத்தை பகிர்ந்து ஐக்கியப்படும் இயக்கத்தின் ஊடக மாநாடு இன்று புதன்கிழமை கொழும்பில் இடம்பெற்றது. இம்மாநாட்டில் சிங்கள, தமிழ் மொழிகளில் உரையாற்றிய மனோ கணேசன் மேலும் கூறியதாவது,
உலகம் ஒரு மத பயங்கரவாதியாக அடையாளம் கண்டுள்ள சர்ச்சைக்குரிய மியான்மார் நாட்டு மத தலைவர் விராது தேரரை இன்று இந்த நாட்டுக்குள்ளே சர்வ மரியாதைகளுடன் அழைத்து வருகிறீர்கள். இந்த நாட்டின் பொதுபல சேனை அடிப்படைவாத அமைப்பு, விராது தேரரின் 969 என்ற அடிப்படைவாத அமைப்புடன் ஒப்பந்தம் செய்து, ஆவணங்களை பரிமாறிக்கொள்கின்றது. அந்த மாநாட்டில் பல இனங்கள் வாழும் இலங்கையின் பன்மை தன்மையை குழப்பி விடும் முகமாக, இலங்கையின் பெயரை சிங்ஹலே என மாற்றவேண்டும் என்றும், இங்கு வாழும் மக்களை சிங்ஹல–பெளத்தர்கள், சிங்ஹல-தமிழர்கள், சிங்ஹல-இந்துகள், சிங்ஹல-முஸ்லிம்கள், சிங்ஹல-கிறிஸ்தவர்கள் என அழைக்க வேண்டும் என்றும், தேசியக்கொடியை இன்னமும் சிங்கள பெளத்த மயமாக்க வேண்டும் எனவும் கருத்துகள் கூறப்படுகின்றன.
வெளிநாட்டு விராது தேரின் ஆலோசனைகளின்படி நமது நாட்டில் நடைபெறும் இவை அரசாங்கத்தின் கண்களுக்கு சட்டமீறல்களாக, குற்றங்களாக தெரியவில்லை. ஆனால்,
வெளிநாட்டு அரசியல் தலைவர் முன்னாள் முதல்வர் ஜெயலிதா தொடர்பில் அவரது நாட்டில் நடைபெறும் நிகழ்வுகள் குற்றங்களாக அரசாங்கத்தின் கூட்டு கட்சிகள் சிலவற்றுக்கு தெரிகின்றன. எனவே ஜெயலலிதா பற்றி அவசரப்பட்டு தெரிவிக்கப்படும் அரைவேக்காட்டு கருத்துகளை நாம் ஒருபோதும் ஏற்றுக்கொள்ள முடியாது.
முன்னாள் முதல்வர் ஜெயலலிதா இலங்கை நீதிமன்றத்தில் நிறுத்தப்படவில்லை. இலங்கை மக்களின் வரிப்பணத்தை கொள்ளையடித்தார் என குற்றஞ்சாட்டப்படவில்லை. எனவே அவரைப்பற்றி கருத்து கூறுமுன் இவர்கள் தங்களை திருத்தி கொள்ள வேண்டும். மாநிலத்திலும், தேசியரீதியாகவும் பலமான ஒரு அரசியல் தலைவரையும் நீதிமன்றத்துக்கு கொண்டு செல்லும் இந்திய நீதித்துறையை பார்த்து பாடம் படிக்க வேண்டும். இலங்கையில் நீதித்துறையின் சுதந்திரத்திற்கு அரசாங்கத்தினால் ஏற்படுத்தப்பட்டுள்ள அச்சுறுத்தலை கவனத்தில் கொள்ள வேண்டும்.
அதிமுக தலைவர் ஜெயலலிதா தனது ஆட்சிகாலத்தில் இலங்கை தேசிய இனப்பிரச்சினை தொடர்பில் இலங்கை அரசுக்கு எதிரான நிலைப்பாடுகளை எடுத்திருந்தார். இதுவே இவர்களது கோபத்துக்கு காரணமாக அமைந்துள்ளது. அதிமுக தலைவர் ஜெயலலிதா அரசியலில் இருந்து அகற்றப்பட வேண்டும் என்று இவர்கள் எதிர்பார்க்கின்றார்கள். இந்த எதிர்பார்ப்பு நல்ல எண்ணம் கொண்டது இல்லை. இங்கே வாழும் தமிழருக்காக அதிகாரத்துடன் குரல் கொடுக்கும் எந்த ஒரு சக்தியும் எந்த ஒரு நாட்டிலும் , குறிப்பாக தமிழகத்தில் இருக்கக் கூடாது என்ற எண்ணமே அரசாங்கத்திற்கு உள்ளே நிலவுகின்றது.

A renewed U.S.-India partnership for the 21st century

Narendra Modi is prime minister of India. Barack Obama is president of the United States.
As nations committed to democracy, liberty, diversity and enterprise, India and the United States are bound by common values and mutual interests. We have each shaped the positive trajectory of human history, and through our joint efforts, our natural and unique partnership can help shape international security and peace for years to come.
Ties between the United States and India are rooted in the shared desire of our citizens for justice and equality. When Swami Vivekananda presented Hinduism as a world religion, he did so at the 1893 World’s Parliament of Religions in Chicago. When Martin Luther King Jr. sought to end discrimination and prejudice against African Americans, he was inspired by Mahatma Gandhi’s nonviolent teachings. Gandhiji himself drew upon the writings of Henry David Thoreau.
As nations, we've partnered over the decades to deliver progress to our people. The people of India remember the strong foundations of our cooperation. The food production increases of the Green Revolution and the Indian Institutes of Technology are among the many products of our collaboration.
Today our partnership is robust, reliable and enduring, and it is expanding. Our relationship involves more bilateral collaboration than ever before — not just at the federal level but also at the state and local levels, between our two militaries, private sectors and civil society. Indeed, so much has happened that, in 2000, then-Prime Minister Atal Bihari Vajpayee could declare that we are natural allies.
After many years of growing cooperation since, on any given day, our students work together on research projects, our scientists develop cutting-edge technology and senior officials consult closely on global issues. Our militaries conduct joint exercises in air, on land and at sea, and our space programs engage in unprecedented areas of cooperation, leading us from Earth to Mars. And in this partnership, the Indian American community has been a vibrant, living bridge between us. Its success has been the truest reflection of the vitality of our people, the value of America’s open society and the strength of what we can do when we join together.
Still, the true potential of our relationship has yet to be fully realized. The advent of a new government in India is a natural opportunity to broaden and deepen our relationship. With a reinvigorated level of ambition and greater confidence, we can go beyond modest and conventional goals. It is time to set a new agenda, one that realizes concrete benefits for our citizens.
This will be an agenda that enables us to find mutually rewarding ways to expand our collaboration in trade, investment and technology that harmonize with India’s ambitious development agenda, while sustaining the United States as the global engine of growth. When we meet today in Washington, we will discuss ways in which we can boost manufacturing and expand affordable renewable energy, while sustainably securing the future of our common environment.
We will discuss ways in which our businesses, scientists and governments can partner as India works to improve the quality, reliability and availability of basic services, especially for the poorest of citizens. In this, the United States stands ready to assist. An immediate area of concrete support is the “Clean India” campaign, where we will leverage private and civil society innovation, expertise and technology to improve sanitation and hygiene throughout India.
While our shared efforts will benefit our own people, our partnership aspires to be larger than merely the sum of its parts. As nations, as people, we aspire to a better future for all; one in which our strategic partnership also produces benefits for the world at large. While India benefits from the growth generated by U.S. investment and technical partnerships, the United States benefits from a stronger, more prosperous India. In turn, the region and the world benefit from the greater stability and security that our friendship creates. We remain committed to the larger effort to integrate South Asia and connect it with markets and people in Central and Southeast Asia.
As global partners, we are committed to enhancing our homeland security by sharing intelligence, through counterterrorism and law-enforcement cooperation, while we jointly work to maintain freedom of navigation and lawful commerce across the seas. Our health collaboration will help us tackle the toughest of challenges, whether combating the spread of Ebola, researching cancer cures or conquering diseases such as tuberculosis, malaria and dengue. And we intend to expand our recent tradition of working together to empower women, build capacity and improve food security in Afghanistan and Africa.
The exploration of space will continue to fire our imaginations and challenge us to raise our ambitions. That we both have satellites orbiting Mars tells its own story. The promise of a better tomorrow is not solely for Indians and Americans: It also beckons us to move forward together for a better world. ஆயிரத்துக்கும் மேற்பட்ட பக்கங்கள் கொண்ட தீர்ப்பின் 'ஆபரேட்டிவ் போர்ஷன்’ என்று சொல்லப்படும் தீர்ப்பின் சாராம்சத்தை நீதிபதி குன்ஹா இப்படித்தான் தொடங்கினார்...
ஒவ்வொருவருக்குமான தண்டனை விவரங்களைப் பிறகு அறிவிக்கிறேன். நீங்கள் ஏதாவது சொல்ல விரும்பினால் சொல்லலாம்.''- நீதிபதி ஜான் மைக்கேல் டி.குன்ஹா இப்படி வாசித்து முடித்ததும் ஜெயலலிதா, சசிகலா, இளவரசி, சுதாகரன் ஆகியோரோடு அவர்களுடைய வழக்கறிஞர்களின் முகமும் இருண்டு போனது. அப்போது நேரம் 11.30 மணி!
அப்போதே ஜெயலலிதாவின் காரில் இருந்த தேசியக் கொடி அகற்றப்பட்டது. அந்த ஒரு நிகழ்வே நீதிமன்ற அறைக்கு வெளியில் நின்றுகொண்டிருந்த அ.தி.மு.க-வைச் சேர்ந்த அமைச்சர்கள் மற்றும் எம்.எல்.ஏ-க்களுக்கு நிலைமையை உணர்த்திவிட்டது. அனைவரும் சோகத்தில் மரத்தடியில் அமர்ந்துவிட்டனர்.
மீண்டும் வாதங்கள்!
மாலையில் நீதிபதி குன்ஹா தண்டனை விவரத்தை வாசித்தார்.
''குற்றவாளிகள் மீது சுமத்தப்பட்ட குற்றங்களுக்குத் தண்டனையாக ஒவ்வொருவருக்கும் தலா நான்கு வருடங்கள் சிறைத் தண்டனை அளிக்கிறேன். அதுபோல, முதல் குற்றவாளிக்கு அபராதத் தொகையாக 100 கோடி ரூபாய் விதிக்கிறேன். வழக்குத் தொடரப்பட்டபோது வழக்கில் தவறான வழிகளில் சேர்க்கப்பட்டு நீதிமன்றத்தோடு இணைக்கப்பட்ட சொத்து மதிப்பு 66 கோடி ரூபாய். அது அரசாங்க மதிப்பீட்டின்படி கணக்கிடப்பட்டுள்ளது. தற்போது அதன் மதிப்பு 5 மடங்காக அதிகரித்துள்ளது. எனவே, அபராதத் தொகை அதற்கேற்றவாறு கணக்கிடப்பட்டு நூறு கோடி ரூபாய் என்று அறிவிக்கப்பட்டுள்ளது. முதல் குற்றவாளி, இந்த அபராதத்தைக் கட்டாத நிலையில் கூடுதலாக ஒரு வருடம் சிறைத் தண்டனை அனுபவிக்க வேண்டும். அதுபோல, மற்ற குற்றவாளிகள் தங்களது அபராதத்தைச் செலுத்தத் தவறினால் கூடுதலாக ஆறுமாதங்கள் சிறைத் தண்டனை அனுபவிக்க வேண்டும்'' என்று முடித்தார்.
'பல லட்சம் கோடி ரூபாய் ஊழல்களை மிகச் சாதாரணமாகச் சாதித்துவிடும் எந்த அரசியல்வாதிக்கும் இதுவரை 100 கோடி ரூபாய் அபராதம்’ என்று விதிக்கப்பட்டது இல்லை. இத்தனை பெரிய தொகையை அபராதமாகச் செலுத்த அறிவுறுத்தப்பட்ட முதல் அரசியல்வாதி, முதல் முதலமைச்சர் ஜெயலலிதாதான்.
''இப்போது இந்த அபராதம் பற்றி தவறான தகவல்கள் வருகின்றன. அதாவது, ஏற்கெனவே பறிமுதல் செய்யப்பட்ட 66 கோடி ரூபாய் சொத்துகள் போக, மீதம் 34 கோடி ரூபாய் மட்டும் அபராதமாக செலுத்தினால் போதும் என்று சொல்கின்றனர். ஆனால், தீர்ப்பில் நீதிபதி அப்படிச் சொல்லவில்லை. 100 கோடி ரூபாய் அபராதம் என்பது தனியானது. பறிமுதல் செய்யப்பட்ட சொத்துகளுக்கும் இதற்கும் எந்தச் சம்பந்தமும் இல்லை. ஏனென்றால், பறிமுதல் செய்யப்பட்ட சொத்துகள் அனைத்தும் அரசாங்கத்தினுடையவை.
ஒருவர் முதலமைச்சராக இருக்கும்போது அவருடைய வருமானத்தைத் தாண்டி அவருக்குக் கொடுக்கப்படும் அன்பளிப்புகள் மற்றும் வருவாய்கள் அனைத்தும் அரசாங்கத்தின் கருவூலத்தில் சேர்க்கப்பட வேண்டும் என்பது விதிமுறை. அதன்படி ஜெயலலிதாவின் வருமானத்துக்கு அதிகமாக சேர்க்கப்பட்டு இருந்த சொத்துகள் அனைத்தும் அரசாங்கக் கருவூலத்தில் சேர்க்கப்படும். அது தவிர்த்து, தனியாக 100 கோடி ரூபாயை அபராதமாக ஜெயலலிதா கட்ட வேண்டும். அதுவும் முறையான கணக்கு வழக்கு காட்டப்பட்ட பணத்தில் கட்ட வேண்டும். அந்த அபராதத்தைச் செலுத்தி அதற்கான ரசீதை நீதிமன்றத்தில் சமர்ப்பித்தால் மட்டுமே அவர் மேல்முறையீட்டுக்கோ அல்லது ஜாமீன் கேட்டோ விண்ணப்பிக்க முடியும்'' என்று நீதித்துறை வல்லுநர்கள் சொல்கிறார்கள்.
மேல் முறையீடும் அப்பீலும்!
இந்த வழக்கில் மேல்முறையீடும் (அப்பீல்) ஜாமீனும் தனித்தனியாகக் கிடையாது. மேல்முறையீடு செய்யும்போது, 'நான் இந்த வழக்கில் மேல்முறையீடு செய்கிறேன். எனக்கு ஜாமீனும் வழங்க வேண்டும்’ என்று மனுச்செய்ய வேண்டும். ஆனால், தீர்ப்பின் நகல் இவர்கள் கையில் கிடைக்கும் வரை அவர்கள் மேல்முறையீடு செய்ய முடியாது. மேலும் மேல்முறையீடு செய்யும்போது அவர்கள் அபராதத் தொகையைச் செலுத்தி அதற்கான ரசீதை இணைத்திருக்க வேண்டும். அப்போதுதான் அந்த மனு விசாரணைக்கே ஏற்றுக்கொள்ளப்படும். இந்தத் தொகை அதிகம் என்றும் கட்டுவதில் சிரமம் என்றும் சொன்னால், அதற்காகத் தனியாக கர்நாடகா உயர் நீதிமன்றத்தில் வழக்குத் தாக்கல் செய்ய வேண்டும். அதில், தீர்ப்பு வரும் வரை சொத்துக் குவிப்பு வழக்கில் மேல்முறையீடுக்கும் ஜாமீனுக்கும் விண்ணப்பிக்க முடியாது.
வழக்குச் செலவை யார் கொடுப்பது?
சொத்துக் குவிப்பு வழக்கை தமிழகத்தில் இருந்து பெங்களூருக்கு மாற்றியது முதல், அந்த வழக்கை நடத்த இதுவரை 5 கோடி ரூபாய் செலவாகியுள்ளது. அந்தச் செலவை கர்நாடக அரசுக்கு தமிழக அரசு கொடுக்க வேண்டும். அந்தத் தொகையை தமிழக அரசு கட்டத் தவறினால், ஜெயலலிதா 1991-க்கு முன்பாக தனக்கு இருந்ததாகக் காட்டியுள்ள சொத்துகளை விற்று அந்த ஐந்து கோடியைக் கட்ட வேண்டும்.
போயஸ் கார்டன்!
போயஸ் கார்டன் வீட்டுக்கு ஏதாவது பிரச்னை வருமா? என்ற சந்தேகம் கிளப்பப்படுகிறது. ''அந்த வீடு ஜெயலலிதா முதன்முறையாக முதலமைச்சராவதற்கு முன்பாகக் கட்டப்பட்டது. ஆனால், அதற்குப் பிறகு அவர் அந்த வீட்டில் கூடுதலாகக் கட்டப்பட்ட பகுதிகள், செய்யப்பட்ட ஆடம்பர வேலைப்பாடுகள், அலங்காரப் பொருட்கள் அரசுடைமையாகும்'' என்று சொல்லப்படுகிறது.
காவல் துறையிடம் ஜெயலலிதாவின் கார்!
ஜெயலலிதாவுக்கு பரப்பன அக்ரஹாரா சிறையில் மருத்துவர்கள் உடல் நிலையை பரிசோதித்தனர். அப்போது அவருக்கு ரத்த அழுத்தம் சீரற்ற நிலையில் இருந்தது. அதற்கான சிகிச்சை அளித்தனர். அரை மணி நேரத்தில் ரத்த அழுத்தம் சீரானது. அதன்பிறகு, நான்கு பேரையும் சிறைக்கு அனுப்ப நீதிபதி குன்ஹா உத்தரவு பிறப்பித்தார்.
சசிகலா, சுதாகரன், இளவரசி ஆகியோர் சிறைக்கு அனுப்பப்பட்டனர். ஆனால், ஜெயலலிதாவுக்கு இசட் பிளஸ் பாதுகாப்பு இருப்பதால், அவரை அவர்கள் பொறுப்பில் இருந்து தங்கள் கஸ்டடியில் எடுப்பதற்குள் கர்நாடக மாநில காவலர்களுக்குப் பெரும்பாடாகிவிட்டது. இசட் பிளஸ் பாதுகாப்பில் உள்ள தேசிய பாதுகாப்புப் படையினர், 'எழுத்துப்பூர்வமாக எழுதிக் கொடுத்தால்தான், நாங்கள் அவரை அனுப்புவோம்’ என்றனர். இதில் டென்ஷனான கர்நாடக மாநில போலீஸார், 'நீதிமன்ற உத்தரவைக் கேட்டீர்கள் அல்லவா? மக்கள் பிரதிநிதித்துவச் சட்டப்படி அவர் குற்றவாளி என்று அறிவிக்கப்பட்டவுடன் அவர் பதவி உட்பட அவருக்குரிய சலுகைகள் அனைத்தையும் இழந்தவராகிறார். நாங்கள் எழுத்துப்பூர்வமாக கொடுப்பதற்கு எந்த அவசியமும் இல்லை’ என்றனர். அதன்பிறகு ஜெயலலிதாவை கர்நாடக காவல் துறையிடம் ஒப்படைத்தனர்.
அதன் பிறகு, ஜெயலலிதாவின் காரில் அவரை அழைத்துச் சென்று பரப்பன அக்ரஹாரா சிறையில், எண் 7402 அறைக்கு அழைத்துச் சென்றனர். அப்போது மணி சரியாக இரவு 8.20.

ஆயிரத்துக்கும் மேற்பட்ட பக்கங்கள் கொண்ட தீர்ப்பின் 'ஆபரேட்டிவ் போர்ஷன்’ என்று சொல்லப்படும் தீர்ப்பின் சாராம்சத்தை நீதிபதி குன்ஹா இப்படித்தான் தொடங்கினார்...
''66 கோடி ரூபாய் சொத்துக் குவிப்பு வழக்கில் 53 (53,60,49,954 ரூபாய்) கோடி ரூபாய் வருமானம் முறைகேடான வழிகளில் சம்பாதிக்கப்பட்டுள்ளது என்பது இந்த வழக்கில் சந்தேகத்துக்கு இடமின்றி நிரூபணமாகி உள்ளது. இந்த வழக்கின் முதல் குற்றவாளியாகச் சேர்க்கப்பட்டு உள்ளவர், பொது ஊழியராகப் பொறுப்பில் இருந்த காலத்தில், இந்தக் குற்றத்தில் ஈடுபட்டுள்ளார். வருமானத்துக்கு அதிகமாகச் சொத்து சேர்த்துள்ளது சந்தேகத்துக்கு இடமின்றி நிரூபணமாகி உள்ளது. அவருடைய இந்தச் செயல் ஊழல் தடுப்புச் சட்டம் 13 (i)(e)-ன் படி தண்டனைக்குரிய குற்றம். முதல் குற்றவாளியாகச் சேர்க்கப்பட்டுள்ளவர், இரண்டாவது (சசிகலா), மூன்றாவது ( சுதாகரன்), நான்காவது (இளவரசி) குற்றவாளிகளாகச் சேர்க்கப்பட்டுள்ளவர்களுடன் சேர்ந்து கூட்டுச்சதியில் ஈடுபட்டு குற்றம் புரிந்துள்ளதும் நிரூபணமாகி உள்ளது. இந்தியத் தண்டனைச் சட்டம், பிரிவு 120 (b)-ன் படி 'கூட்டுச்சதி (criminal conspiracy)’ செய்தல் குற்றமாகும்.
இந்த வழக்கில் இரண்டாவது, மூன்றாவது, நான்காவது குற்றவாளிகளாகச் சேர்க்கப்பட்டு உள்ளவர்கள், முதல் குற்றவாளி செய்த குற்றங்களுக்கு உடந்தையாக இருந்துள்ளனர். இந்தியத் தண்டனைச் சட்டம் 109-ன் படி 'குற்றத்துக்கு உடந்தை (aiding and abet)’ என்பதும் குற்றமாகிறது. எனவே, நான்கு பேரும் குற்றவாளிகள் என்று இந்த நீதிமன்றம் அறிவிக்கிறது.
ஒவ்வொருவருக்குமான தண்டனை விவரங்களைப் பிறகு அறிவிக்கிறேன். நீங்கள் ஏதாவது சொல்ல விரும்பினால் சொல்லலாம்.''- நீதிபதி ஜான் மைக்கேல் டி.குன்ஹா இப்படி வாசித்து முடித்ததும் ஜெயலலிதா, சசிகலா, இளவரசி, சுதாகரன் ஆகியோரோடு அவர்களுடைய வழக்கறிஞர்களின் முகமும் இருண்டு போனது. அப்போது நேரம் 11.30 மணி!
அப்போதே ஜெயலலிதாவின் காரில் இருந்த தேசியக் கொடி அகற்றப்பட்டது. அந்த ஒரு நிகழ்வே நீதிமன்ற அறைக்கு வெளியில் நின்றுகொண்டிருந்த அ.தி.மு.க-வைச் சேர்ந்த அமைச்சர்கள் மற்றும் எம்.எல்.ஏ-க்களுக்கு நிலைமையை உணர்த்திவிட்டது. அனைவரும் சோகத்தில் மரத்தடியில் அமர்ந்துவிட்டனர்.
மீண்டும் வாதங்கள்!
மாலையில் நீதிபதி குன்ஹா தண்டனை விவரத்தை வாசித்தார்.
''குற்றவாளிகள் மீது சுமத்தப்பட்ட குற்றங்களுக்குத் தண்டனையாக ஒவ்வொருவருக்கும் தலா நான்கு வருடங்கள் சிறைத் தண்டனை அளிக்கிறேன். அதுபோல, முதல் குற்றவாளிக்கு அபராதத் தொகையாக 100 கோடி ரூபாய் விதிக்கிறேன். வழக்குத் தொடரப்பட்டபோது வழக்கில் தவறான வழிகளில் சேர்க்கப்பட்டு நீதிமன்றத்தோடு இணைக்கப்பட்ட சொத்து மதிப்பு 66 கோடி ரூபாய். அது அரசாங்க மதிப்பீட்டின்படி கணக்கிடப்பட்டுள்ளது. தற்போது அதன் மதிப்பு 5 மடங்காக அதிகரித்துள்ளது. எனவே, அபராதத் தொகை அதற்கேற்றவாறு கணக்கிடப்பட்டு நூறு கோடி ரூபாய் என்று அறிவிக்கப்பட்டுள்ளது. முதல் குற்றவாளி, இந்த அபராதத்தைக் கட்டாத நிலையில் கூடுதலாக ஒரு வருடம் சிறைத் தண்டனை அனுபவிக்க வேண்டும். அதுபோல, மற்ற குற்றவாளிகள் தங்களது அபராதத்தைச் செலுத்தத் தவறினால் கூடுதலாக ஆறுமாதங்கள் சிறைத் தண்டனை அனுபவிக்க வேண்டும்'' என்று முடித்தார்.
'பல லட்சம் கோடி ரூபாய் ஊழல்களை மிகச் சாதாரணமாகச் சாதித்துவிடும் எந்த அரசியல்வாதிக்கும் இதுவரை 100 கோடி ரூபாய் அபராதம்’ என்று விதிக்கப்பட்டது இல்லை. இத்தனை பெரிய தொகையை அபராதமாகச் செலுத்த அறிவுறுத்தப்பட்ட முதல் அரசியல்வாதி, முதல் முதலமைச்சர் ஜெயலலிதாதான்.
''இப்போது இந்த அபராதம் பற்றி தவறான தகவல்கள் வருகின்றன. அதாவது, ஏற்கெனவே பறிமுதல் செய்யப்பட்ட 66 கோடி ரூபாய் சொத்துகள் போக, மீதம் 34 கோடி ரூபாய் மட்டும் அபராதமாக செலுத்தினால் போதும் என்று சொல்கின்றனர். ஆனால், தீர்ப்பில் நீதிபதி அப்படிச் சொல்லவில்லை. 100 கோடி ரூபாய் அபராதம் என்பது தனியானது. பறிமுதல் செய்யப்பட்ட சொத்துகளுக்கும் இதற்கும் எந்தச் சம்பந்தமும் இல்லை. ஏனென்றால், பறிமுதல் செய்யப்பட்ட சொத்துகள் அனைத்தும் அரசாங்கத்தினுடையவை.
ஒருவர் முதலமைச்சராக இருக்கும்போது அவருடைய வருமானத்தைத் தாண்டி அவருக்குக் கொடுக்கப்படும் அன்பளிப்புகள் மற்றும் வருவாய்கள் அனைத்தும் அரசாங்கத்தின் கருவூலத்தில் சேர்க்கப்பட வேண்டும் என்பது விதிமுறை. அதன்படி ஜெயலலிதாவின் வருமானத்துக்கு அதிகமாக சேர்க்கப்பட்டு இருந்த சொத்துகள் அனைத்தும் அரசாங்கக் கருவூலத்தில் சேர்க்கப்படும். அது தவிர்த்து, தனியாக 100 கோடி ரூபாயை அபராதமாக ஜெயலலிதா கட்ட வேண்டும். அதுவும் முறையான கணக்கு வழக்கு காட்டப்பட்ட பணத்தில் கட்ட வேண்டும். அந்த அபராதத்தைச் செலுத்தி அதற்கான ரசீதை நீதிமன்றத்தில் சமர்ப்பித்தால் மட்டுமே அவர் மேல்முறையீட்டுக்கோ அல்லது ஜாமீன் கேட்டோ விண்ணப்பிக்க முடியும்'' என்று நீதித்துறை வல்லுநர்கள் சொல்கிறார்கள்.
மேல் முறையீடும் அப்பீலும்!
இந்த வழக்கில் மேல்முறையீடும் (அப்பீல்) ஜாமீனும் தனித்தனியாகக் கிடையாது. மேல்முறையீடு செய்யும்போது, 'நான் இந்த வழக்கில் மேல்முறையீடு செய்கிறேன். எனக்கு ஜாமீனும் வழங்க வேண்டும்’ என்று மனுச்செய்ய வேண்டும். ஆனால், தீர்ப்பின் நகல் இவர்கள் கையில் கிடைக்கும் வரை அவர்கள் மேல்முறையீடு செய்ய முடியாது. மேலும் மேல்முறையீடு செய்யும்போது அவர்கள் அபராதத் தொகையைச் செலுத்தி அதற்கான ரசீதை இணைத்திருக்க வேண்டும். அப்போதுதான் அந்த மனு விசாரணைக்கே ஏற்றுக்கொள்ளப்படும். இந்தத் தொகை அதிகம் என்றும் கட்டுவதில் சிரமம் என்றும் சொன்னால், அதற்காகத் தனியாக கர்நாடகா உயர் நீதிமன்றத்தில் வழக்குத் தாக்கல் செய்ய வேண்டும். அதில், தீர்ப்பு வரும் வரை சொத்துக் குவிப்பு வழக்கில் மேல்முறையீடுக்கும் ஜாமீனுக்கும் விண்ணப்பிக்க முடியாது.
வழக்குச் செலவை யார் கொடுப்பது?
சொத்துக் குவிப்பு வழக்கை தமிழகத்தில் இருந்து பெங்களூருக்கு மாற்றியது முதல், அந்த வழக்கை நடத்த இதுவரை 5 கோடி ரூபாய் செலவாகியுள்ளது. அந்தச் செலவை கர்நாடக அரசுக்கு தமிழக அரசு கொடுக்க வேண்டும். அந்தத் தொகையை தமிழக அரசு கட்டத் தவறினால், ஜெயலலிதா 1991-க்கு முன்பாக தனக்கு இருந்ததாகக் காட்டியுள்ள சொத்துகளை விற்று அந்த ஐந்து கோடியைக் கட்ட வேண்டும்.
போயஸ் கார்டன்!
போயஸ் கார்டன் வீட்டுக்கு ஏதாவது பிரச்னை வருமா? என்ற சந்தேகம் கிளப்பப்படுகிறது. ''அந்த வீடு ஜெயலலிதா முதன்முறையாக முதலமைச்சராவதற்கு முன்பாகக் கட்டப்பட்டது. ஆனால், அதற்குப் பிறகு அவர் அந்த வீட்டில் கூடுதலாகக் கட்டப்பட்ட பகுதிகள், செய்யப்பட்ட ஆடம்பர வேலைப்பாடுகள், அலங்காரப் பொருட்கள் அரசுடைமையாகும்'' என்று சொல்லப்படுகிறது.
காவல் துறையிடம் ஜெயலலிதாவின் கார்!
ஜெயலலிதாவுக்கு பரப்பன அக்ரஹாரா சிறையில் மருத்துவர்கள் உடல் நிலையை பரிசோதித்தனர். அப்போது அவருக்கு ரத்த அழுத்தம் சீரற்ற நிலையில் இருந்தது. அதற்கான சிகிச்சை அளித்தனர். அரை மணி நேரத்தில் ரத்த அழுத்தம் சீரானது. அதன்பிறகு, நான்கு பேரையும் சிறைக்கு அனுப்ப நீதிபதி குன்ஹா உத்தரவு பிறப்பித்தார்.
சசிகலா, சுதாகரன், இளவரசி ஆகியோர் சிறைக்கு அனுப்பப்பட்டனர். ஆனால், ஜெயலலிதாவுக்கு இசட் பிளஸ் பாதுகாப்பு இருப்பதால், அவரை அவர்கள் பொறுப்பில் இருந்து தங்கள் கஸ்டடியில் எடுப்பதற்குள் கர்நாடக மாநில காவலர்களுக்குப் பெரும்பாடாகிவிட்டது. இசட் பிளஸ் பாதுகாப்பில் உள்ள தேசிய பாதுகாப்புப் படையினர், 'எழுத்துப்பூர்வமாக எழுதிக் கொடுத்தால்தான், நாங்கள் அவரை அனுப்புவோம்’ என்றனர். இதில் டென்ஷனான கர்நாடக மாநில போலீஸார், 'நீதிமன்ற உத்தரவைக் கேட்டீர்கள் அல்லவா? மக்கள் பிரதிநிதித்துவச் சட்டப்படி அவர் குற்றவாளி என்று அறிவிக்கப்பட்டவுடன் அவர் பதவி உட்பட அவருக்குரிய சலுகைகள் அனைத்தையும் இழந்தவராகிறார். நாங்கள் எழுத்துப்பூர்வமாக கொடுப்பதற்கு எந்த அவசியமும் இல்லை’ என்றனர். அதன்பிறகு ஜெயலலிதாவை கர்நாடக காவல் துறையிடம் ஒப்படைத்தனர்.
அதன் பிறகு, ஜெயலலிதாவின் காரில் அவரை அழைத்துச் சென்று பரப்பன அக்ரஹாரா சிறையில், எண் 7402 அறைக்கு அழைத்துச் சென்றனர். அப்போது மணி சரியாக இரவு 8.20.
