A Seattle federal judge on Friday put a nationwide block on U.S. President Donald Trump's week-old executive order that had temporarily barred refugees and nationals from seven countries from entering the United States.

The judge's temporary restraining order represents a major setback for Trump's action, though the White House said late Friday that it believed the ban to be "lawful and appropriate" and that the U.S. Department of Justice would file an emergency appeal.

Still, just hours after the ruling, U.S. Customs and Border Protection told airlines they could board travellers who had been affected by the ban.

Trump's Jan. 27 order caused chaos at airports across the United States last week as some citizens from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen were denied entry. Virtually all refugees were also barred, upending the lives of thousands of people who had spent years seeking asylum in the U.S.

The State Department said Friday that almost 60,000 visas were suspended in the wake of Trump's order; it was not clear Friday night whether that suspension was automatically revoked or what travellers with such visas might confront at U.S. airports.

While a number of lawsuits have been filed over Trump's action, the Washington state lawsuit was the first to test the broad constitutionality of the executive order. Judge James Robart, a George W. Bush appointee, explicitly made his ruling apply across the country, while other judges facing similar cases have so far issued orders concerning only specific individuals.

The challenge in Seattle was brought by the state of Washington and later joined by the state of Minnesota. The judge ruled that the states have legal standing to sue, which could help Democratic attorneys general take on Trump in court on issues beyond immigration.

Washington's case was based on claims that the state had suffered harm from the travel ban, for example students and faculty at state-funded universities being stranded overseas. Amazon.com (AMZN.O) and Expedia (EXPE.O), both based in Washington state, had supported the lawsuit, asserting that the travel restrictions harmed their businesses.

Tech companies, which rely on talent from around the world, have been increasingly outspoken in their opposition to the Trump administration's anti-immigrant policies.

Judge Robart probed a Justice Department lawyer on what he called the "litany of harms” suffered by Washington state’s universities, and also questioned the administration's use of the Sept. 11, 2001, attacks on the United States as a justification for the ban.

Robart said no attacks had been carried out on U.S. soil by individuals from the seven countries affected by the travel ban since that assault. For Trump’s order to be constitutional, Robart said, it had to be “based in fact, as opposed to fiction.”

Gulf carrier Qatar Airways will allow passengers barred by an executive order last week to board flights to the United States, after Robart's order, a spokeswoman told Reuters.

But for some who had changed their travel plans following the ban, the order was not enough reassurance.

In Dubai, Tariq Laham, 32, and his fiance Natalia had scrapped plans to travel to the U.S. after their July wedding in Poland, where Natalia is from.

Laham said the couple would not reverse their decision.

"It is just too risky," said Laham, a Syrian who works as a director of commercial operations at a multinational technology company. "Everyday you wake up and there is a new decision."

"OUTRAGEOUS ORDER"

The White House said it would file an appeal as soon as possible.

    “At the earliest possible time, the Department of Justice intends to file an emergency stay of this outrageous order and defend the executive order of the president, which we believe is lawful and appropriate,” the White House said in a statement.

"The president’s order is intended to protect the homeland and he has the constitutional authority and responsibility to protect the American people."

Washington Governor Jay Inslee celebrated the decision as a victory for the state, adding: "No person - not even the president - is above the law."

The judge's decision was welcomed by groups protesting the ban.

“This order demonstrates that federal judges throughout the country are seeing the serious constitutional problems with this order,” said Nicholas Espiritu, a staff attorney at the National Immigration Law Center.

Eric Ferrero, Amnesty International USA spokesman, lauded the short-term relief provided by the order but added: "Congress must step in and block this unlawful ban for good."

But the fluid legal situation was illustrated by the fact that Robart's ruling came just hours after a federal judge in Boston declined to extend a temporary restraining order allowing some immigrants into the United States from countries affected by Trump's three-month ban.

A Reuters poll earlier this week indicated that the immigration ban has popular support, with 49 percent of Americans agreeing with the order and 41 percent disagreeing. Some 53 percent of Democrats said they "strongly disagree" with Trump's action while 51 percent of Republicans said they "strongly agree."

At least one company, the ride-hailing giant Uber, was moving quickly Friday night to take advantage of the ruling.

CEO Travis Kalanick, who quit Trump's business advisory council this week in the face of a fierce backlash from Uber customers and the company's many immigrant drivers, said on Twitter: "We have a team of in-house attorneys who’ve been working night & day to get U.S. resident drivers & stranded families back into country.

FOUR STATES IN COURT

The decision in Washington state came at the end of a day of furious legal activity around the country over the immigration ban. The Trump administration has justified its actions on national security grounds, but opponents have labelled it an unconstitutional order targeting people based on religious beliefs.

In Boston, U.S. District Judge Nathan Gorton expressed scepticism during oral arguments about a civil rights group's claim that Trump's order represented religious discrimination, before declining to extend the restraining order.

U.S. District Judge Leonie Brinkema in Alexandria, Virginia, ordered the federal government to give the state a list by Thursday of "all persons who have been denied entry to or removed from the United States."

The state of Hawaii on Friday also filed a lawsuit alleging that the order is unconstitutional and asking the court to block the order across the country.

He lists several examples of Syrian friends from around the world, whose work and personal life had been thrown into disarray by Trump's orders.

One has been unable to visit family residing in the U.S., while another was unsure whether they would be able to take up a job offer in California after their U.S. visa appointment was cancelled in the wake of the ban.

Indian entrepreneurs suggest suitable strategies for industrializing Jaffna

JAFFNA: Indian entrepreneurs who participated in the Jaffna International Trade Fair held here between January 27 and 29, have suggested strategies to industrialize Jaffna and the rest of Sri Lanka’s Tamil-speaking Northern Province making use of local resources and talent.

Amandeep Azad of Azad Engineering Company of Gaziabad, who manufactures small and medium sized machines to process coconuts and make coconut based products, said that with coconuts being available aplenty in the Northern Province, coconut based industries which can even be run by housewives in their homes have a bright future.

He delineated the wide range of products which can be made out of the coconut tree which includes a method of using a particular coconut product for water retention in agriculture. This is will be useful as water is scarce in most parts of the Jaffna Peninsula.

Azad regretted that a coconut, which is available in Jaffna at LKR 34 ( as against LKR 4 in Colombo), is sent to Colombo for oil extraction and sent back to Jaffna for sale at a high price.
“We must follow the Chinese practice of locating factories at the source,” he suggested.

The Gazhiabad entrepreneur, who is one of the 65 Indian entrepreneurs brought to the Jaffna Fair by ASSOCHAM, said that India can supply machines of various sizes and capabilities.

“I have a coconut processing machine which can be operated at home by a housewife. This will turn women into income earners without leaving their homes,” he said.

Azad’s ideas fully tally with the approach of the Northern Province Chief Minister C.V.

Wigneswaran, who has been seeking the establishment of small and medium industries in place of the big ticket and large scale industries planned by the Sri Lankan government.

According to Wigneswaran, a region like the Sri Lankan North which was battered by war and is lacking in livelihood opportunities, needs projects which can provide  a large number of jobs to people with minimal skills.

“Jaffna today looks like the India of the 1970s. India changed because government put money into the development of small and medium industries,” Azad said.

Rajneesh Mehrish of Sindhuri Biotec of Palam, New Delhi, stressed the importance of acquiring language skills if Jaffna is to come out of its shell.

“Few local businessmen were able to communicate  with us. We knew no Tamil and they knew no English. We tried to recruit some bilingual people but this is no substitute for having a common language of communication between the seller and buyer,” Mehrish said.

He cited his experience at the Guanghou Trade Fair in China where the local government gave each foreign stall, two trained Chinese-English translators

Harish Singla of Goyum Screw Press of Ludhiana, which makes oil extraction machines, joined Azad in highlighting the absence of the entrepreneurial spirit in Jaffna.

“In our interactions with local businessmen at the Jaffna Chamber of Commerce we found that they were traders and not manufacturers .Therefore there  is  little we can do in terms of setting up Joint Ventures to manufacture products here,” Singla said.

Indentifying the roots of the problem, the Indian entrepreneurs pointed to a lack of exposure to the outside world and non-availability of micro and medium scale finances in Jaffna.

All of them said that opening of a road ,sea or air link between Jaffna and India will lead to the flow of ideas and open locals to the immense possibilities of entrepreneurial development in their own areas.

R.Vignesh, the President of the Jaffna Chamber of Commerce and Industry, said that the basic problem in the Northern Province is the apathy of the administration. A disconnect between the government and the private sector prevents the development of entrepreneurship.

The other problem is the easy availability of credit for buying consumer goods which encourages imports from other parts of the country and overseas and discourages local manufacturing.

Two snowshoers from Kashmir have alleged they have been denied visa to the US due to "current (US) policy" even as American Embassy in New Delhi maintained that Indians are not affected by the recent executive order of President Donald Trump.

"Indian Snowshoers Denied Visas, due to 'current (US) policy'. This from our good friend Abid Khan, from Kashmir, minutes ago in our Facebook Messaging," Clyde Rabideau, Mayor of the Village of Saranac Lake in New York, wrote on his Facebook page.

The snowshoers reportedly denied visas are Abid Khan and Tanveer Hussain. They were supposed to take part in the 2017 World Snowshoe Championships in New York from February 24-25.

When contacted, US Embassy Spokesperson in Delhi said, "For privacy reasons we cannot discuss specific visa cases. However, we note that Indian citizens are not affected by the recent executive order."

According to the conversation posted by Rabideau on his page, Khan informed him about the denial of the visa.

"Sorry sir, Visa denied," Khan wrote to the Mayor, a Democrat.

Khan claimed all the paperwork for both the athletes was in order including "local Government sponsorship, federation, your support letter, my financial background. They did not missed (sic) any supporting document."

"The lady officer at US embassy in New Delhi after checking all docs (sic), just went inside into another room. After returning she said 'Sorry, due to our current policy we cant issue you visa'," Khan said.

Rabideau, while promising help with the visa, said, "This will not stand."

Trump signed an executive order last week barring citizens from Syria, Iraq, Iran, Yemen, Libya, Somalia and Sudan from entering the country for 90 days and suspended the admission of all refugees for 120 days. The order indefinitely bans entry of those fleeing from war-torn Syria. PTI

Iran’s missile launch gives the Russian-U.S. honeymoon its first crisis

On Jan. 29, Iran conducted a test launch of a mid-range missile, which the U.S. considers a violation of a United Nations Security Council resolution. Russia, however, might not back its new American friend on this issue, say experts.

While Trump's arrival in the White House has led to an improvement in Russian-American relations, there are certain issues where the countries have significantly different positions.

The most obvious one involves the future of Barack Obama’s U.S.-Iran nuclear deal, which Trump often criticized during his election campaign. Then, as if probing Trump’s resolve, Teheran this week tested a mid-range missile, which Fox News reported flew 360 miles.

Washington views the missile test as proof of the fact that Iran has violated UN Security Council Resolution 2231, which bans Iran from testing missiles that are capable of carrying nuclear warheads, writes (in Russian) the newspaper, Vzglyad. Experts, however, say that Russia may not join U.S. efforts to contain Iran, despite the formal improvement of Russian-U.S. relations.

Today, Russia will probably not support the U.S. and Israel in their harsh position toward Iran, even though in 2010 it supported sanctions, writes Vzglyad. Although it seems that Russia and America's leaders favor closer cooperation in key issues of world politics, Trump's strident criticism of the U.S.-Iranian deal worries Russia's leadership.

"The Syrian gambit, in which Moscow actively cooperates with Teheran, is still not finished," political analyst and Middle East expert, Tofik Abbatov, told (in Russian) Vzglyad adding that Moscow will unlikely want to worsen relations with one of the major players in the Middle East. Iran has significant influence on resolving the Syrian crisis.

Abbatov also noted that Iran never had hopes that relations with Washington would improve. "Immediately after concluding the nuclear deal with the Americans there was the opportunity to continue discussing regional problems," writes (in Russian) Vzglyad, citing Abbatov. "Iran's supreme leader Ayatollah Khamenei said there’d be no further agreements with the U.S. and that the nuclear deal is a maximum concession."

Abbatov believes that Iran's political leadership was very disturbed by "Muammar Gaddafi's unfortunate experience," and therefore does not intend to normalize relations with the U.S., and does not really care about Russia's reaction. Iran is ready and able to act alone, without relying on anyone.
It’s still not clear whether Trump will rescind the U.S.-Iran deal, but if he does as a reaction to Teheran's missile launch, it may be the first serious test of not only his Middle East policy, but also his policy towards Moscow.

The state-run Global Times speculated Trump could request more access to India's market while following protectionist policies at home.

 Beijing: President Donald Trump's 'bring jobs back to America' policy could challenge Prime Minister Narendra Modi's 'Make in India' initiative, Chinese media warned on Monday, even as it commented that the US' continued engagement with Asian allies may benefit Indo-US ties.
"It is being speculated that Trump could request more access to India's market while following protectionist policies at home," an article in the state-run Global Times said.

"This move would impact firms outsourcing to India and Indian exporters, particularly in the sectors of IT and pharmaceuticals. Currently, India has one of the largest numbers of educated, technically trained people in the world, making it a favoured outsourcing destination for some of the largest US firms. Trump's 'bring jobs back to America' is a challenge to Modi's 'Make in India'," it said.

"With regard to Iran, India wouldn't want many alterations to the US-Iran nuclear deal. The former US-initiated sanctions made it hard for India to engage with Iran and significantly
reduced the imports from its neighbour," it said.

The article noted that Trump has directed the Department of Labour to investigate "all abuses of visa programmes that undercut American workers".

"If any visa restrictions are imposed, they would definitely constrain the movement of Indian IT professionals.

Indians are believed to be the largest recipients of H-1B visas in the US, and IT companies that outsource to India are among the top sponsors of such visas. Such a move will definitely not go down well with Indian public as well as leaders," it said.

But at the same time, the US' continued engagement with its Asian allies like Japan and South Korea would work in India's favour and its commitment to its position on SouthChina Sea might also bring India and US closer, boosting engagement in the field of security, it said.

"Moreover, cooperation on India's anti-terrorism efforts would be welcome," it said.

Donald Trump’s victory upended pollsters and shocked the global community anxiously awaiting the outcome of an extremely raucous and personalised election. The leaders of America’s Republican Party had surmised, after losing to President Barack Obama in 2008 and 2012, that to win in an ethnically diversifying country they would have to broaden their base. Mr Trump, however, did just the opposite by consolidating white majority support by an unabashedly anti-minority and bigoted campaign. The Economist magazine, which had denounced Mr Trump prior to the election, writes that he has “contempt for conservative orthodoxy” and harbours a dystopian vision, bigotry and anti-intellectualism. It concludes that if he has not rewritten the rules of electioneering, he has certainly flouted most of them. His new electoral alliance, transcending traditional party lines, dredges economic fears and racial anxiety of the white majority, that will shrink by 2050 from 61.8 per cent of the population today to 46.6 per cent, if current immigration policies persist. In his victory speech, he called them “the forgotten men and women”.

Though the last-minute intervention by the director of the Federal Bureau of Investigation broke Hillary Clinton’s momentum and distracted attention away from Mr Trump’s sex tapes, she really lost as she did not represent the change which most people sought. His win mirrors a global trend towards the rise of chauvinistic leaders, often highly divisive but certainly autocratic, who rally their nations using past hurts or contemporary angst. Those falling into this category would include Russia’s Vladimir Putin, Turkey’s Recep Tayyip Erdogan of Turkey, China’s Xi Jinping and India’s Narendra Modi. Waiting in the wings are Trump clones like Marine Le Pen, leader of the xenophobic National Front in France, often dubbed Trump Lite. Mr Trump’s apparent threat to the existing geo-economic order, stems from his economic and foreign policy pronouncements in the campaign, a lot even contemptuous of the traditional Republican Party platform. For instance, he condemns all trade agreements, including the North American Free Trade Agreement (Nafta), that integrated the Mexican and Canadian economies with that of the US.

On foreign policy, he advocates a retreat from US “exceptionalism” — a bedrock of the US worldview as the deemed custodian of liberty and freedom worldwide. Mr Trump instead preaches “America First” and an isolationist stance. German Chancellor Angela Merkel, in her congratulatory message, conditioned partnership on respect for human dignity, racial equality and tolerance. A similar message went from the European Union. These are surprisingly blunt signals to the putative leader of the Western alliance. From the fog of electioneering some elements of his putative foreign and domestic policies are emerging. In his victory speech he was moderation incarnate, advocating partnership and not confrontation with nations “willing to get along with us”. Having campaigned against Nafta he would have to at least review if not discard it. The Mexican peso has plunged in anticipation and Canada, which sends three-quarters of its exports to the US, is understandably nervous.

The Trans-Pacific Partnership (TPP), which was to tie the US to 11 partners in the Asia-Pacific region and provide geo-strategic underpinning to containing China, is now in limbo. Japan’s Lower House had already approved the TPP. Prime Minister Shinzo Abe is rushing to engage Mr Trump in the US even before his inauguration to seek clarity about all elements of the US-Japan alliance. Mr Trump’s praise of President Vladimir Putin and signal to Nato allies that to obtain US protection they must commit greater resources increases uncertainty in Europe, already facing universally rising anti-establishment feelings, of which Brexit was a signal. His iconoclastic suggestion, which he may now drop, that Japan and the Republic of Korea could acquire nuclear weapons if they need for self-protection to offset reduced US commitment may undermine the Nuclear Non-Proliferation Treaty, not entirely an unwelcome prospect from India’s perspective.

The Trump approach to the Islamic world is also laden with paradoxes. He has scoffed at Sunni Gulf sheikhdoms and yet also wants to undo the nuclear deal with Iran. At the same time he wants ISIS obliterated, though it seems extremely unlikely that he would be prepared to commit troops for this. He is unlikely to press Israel as Mr Obama did on illegal settlements. But President Obama engaged Iran realising that the US could not counter ISIS without committing troops in West Asia unless the Russia-Iran axis, supplemented by US-boosted Iraqi and Kurdish forces operating under US air cover, was unshackled in northern Syria-Iraq. A group called Hindu Americans for Trump had invited him to a New Jersey temple in a town largely inhabited by Gujarati-origin Indians. Was it PM Narendra Modi’s outreach to Mr Trump using the RSS and Gujarati links? If so, it is a welcome move.

India will have to watch carefully Mr Trump’s policy towards East Asia, including China, Europe, including Russia, and West Asia, mainly Iran. India and Pakistan would perhaps figure lower on his initial list of priorities. On trade and economics, India must monitor his policy on visas, taxing of outsourcing firms and other protectionist steps that may present both challenges and opportunities. Trump Inc has real estate links in Mumbai and Pune. He is also at heart a transactional businessman whom India can engage as he carries little baggage of Cold War links to Pakistan. Mr Modi must find the first opportunity to meet him to develop chemistry and sell a shared vision of 21st century Asia. India-US ties are flourishing but still lack economic and technological depth. Some unfinished business still lingers — such as India’s permanent membership of the UN Security Council, Nuclear Suppliers Group and enhanced defence links. Can Mr Modi’s “Make in India” be meshed with Mr Trump’s “America First” to craft, what President Obama once called, the defining partnership of the 21st century? History beckons both.

“தோழர், சூளைப்பள்ளம் கட்சி ஆபீஸ் பின்னாடி இருக்குற ஒரு பையனை, மயிலாப்பூர் போலீஸ் ஸ்டேஷன்ல வெச்சிருக்காங்களாம். அவங்க அப்பாவோட அங்கதான் இருக்கேன். வர முடியுமா?” பதற்றமும் கவலையுமாக போனில் கூப்பிட்டார் தோழர் தயாளன்…

அடுத்த ஒரு மணி நேரத்தில் மயிலாப்பூர் போலீஸ் ஸ்டேஷனில் நிகழ்ந்த காட்சிகள் மனதைக் கலங்கடித்தன. ‘‘அய்யோ… எம் புள்ளவாழ்க்க பாழாயிடுச்சே’’ என காவல்நிலை யத்தில் புரண்டு அழும் தாய்.‘‘எம் பொண்ணுக்கு இன்னிக்கு கல்யாணங்க… அவங்க அப்பா ஜெயிலுக்கு போனதுனால, நிக்கா நின்னு போயிருச்சே…’’ என மார்பில் அடித்து அழுதுகொண்டிருந்தது ஒரு இஸ்லாமியக் குடும்பம்.‘‘ஓடி வந்த பசங்களுக்கு தண்ணீர் கொடுத்தேண்ணா… அதுக்காக வீட்ல தூங்கிட்டிருந்த எங்க வீட்டுக்காரர அடி அடின்னு அடிச்சி இப்ப ஜெயிலுக்கு கூப்டு போறாங்களே… தண்ணி கொடுத்தது தப்பாண்ணா…’’ கண்ணீரோடு கேட்டார் ஒரு இளம் பெண்.

முதல் மாடியிலிருந்த ஒரு சிறிய அறை யில் 25-க்கும் மேற்பட்ட இளைஞர்கள் கடுமையாகத் தாக்கப்பட்டு கிடத்தி வைக்கப்பட்டனர். அவர்களோடு பேசுவதற்கு அங்கிந்தஇரு காவலர்களும் முதலில் அனுமதிக்க வில்லை. தகராறு செய்து பிறகு ஒரு வழியாக பாதிக்கப்பட்ட இளைஞர்கள் சிலரோடு பேசியபோது, அச்சம் கலையாத மனநிலையுடன் தங்கள் கையையும் காலையும் காண்பித்தனர். போலீஸ் லத்திகளின் அச்சுவலுவாக பதிக்கப்பட்டிருந்த தடம், நடந்ததைச் சொன்னது. பலருக்கு தோல் பிய்ந்து உரிந்திருந்தது. அங்கிருந்த காவலர்கள் எந்தக் கேள்விக்கும் விடை தராமல் மௌனிகளாக இருந்தனர்.

ஸ்டேஷனின் கீழே கூடியிருந்த பெண்கள், தங்கள் பிள்ளைகள் கைதானபோது நடந்த கொடூரத்தையும் காவல் நிலையத்தில் வைத்து அடித்துக் கொடுமைப்படுத்தியதையும் கதறி அழுதவாறு கண்ணீருடன் வெளிப்படுத்தினர். தோழர்கள், ஊடகங்கள், வழக்கறிஞர் களுக்கும் தகவல்கள் கடத்தப்பட்டன. ‘‘ஊரடங்கியிருந்த அதிகாலை வேளையில் 26 பேரை நையப் புடைத்து சிறைக்கு அனுப்பி யது போலவே, இவர்களையும் அனுப்ப முடி யாது. விஷயம் கசிந்து பெரிதாகப் போகிறது’’ என்பதை உணர்ந்தவுடன் உயரதிகாரிகள் பெரிய வாகனங்களில் வந்திறங்கினர். எப்போதும் அப்பாவிகள் எப்படி பயங்கரமான குற்றவாளிகளாக சித்தரிக்கப்பட்டு காவல் வாகனத்தில் ஏற்றப்படுவார்களோ அப்படியே அப்போதும் தொடர்ந்தது…

பேசாப் பொருளைப் பேசத் தொடங்கிய கதை:

ஒரு வாரத்துக்கு முன்னால் மெரினா கடற்கரையோரம் தங்கள் கைக்கு அடக்கமான ஆட்களால், தங்களது நோக்கங்களை மட்டுமே மனதில் வைத்து வடிவமைக்கப்பட்ட ‘ஜல்லிக்கட்டு போராட்டம்’, ஓரிரு நாட்களிலேயே பீறிட்டு பல ரூபங்களில் உருவெடுக்கஆரம்பித்தது. மத்திய அரசருக்கு இணக்கமான தலைமையும், அதற்கேற்றாற் போல் ஊடகங்களின் வெளிச்சமும் இருந்ததால் ‘‘காவல் துறை மக்களின் நண்பன்’’ என்று தம்பட்டம் அடிக்கப்பட்டது.

மனிதர்கள் வெறும் இயந்திரங்கள் அல்லவே. எஜமான் இடும் உத்தரவை மட்டும் நிறைவேற்றிவிட்டுக் கலைந்து செல்ல…ரத்தமும் சதையுமாய் உணர்வும் உணர்ச்சிகளும் கலந்து, காலம் காலமாய் மனிதகுலத்தின் அனுபவங்களை கிரகித்து வினையாற்றும் உயிரினம் தானே மனிதன்… தேச விடுதலைக்காக, சமூகநீதிப் போராட்டத் துக்காக, சாதிய ஒழிப்புக்காக, மொழி – பண் பாட்டு விழுமியங்களின் உரிமைக்காக, பாலின சமத்துவத்துக்கான அரசியலை முன்வைத்து, அதிகார வர்க்கத்தின் அடக்குமுறையை எதிர்த்து… இப்படியாய் காலந்தோறும் கேட்டுக் கேட்டு செரித்த கடற்கரை மணல் வெளி, இப்போது அதன் வேலையை சிறப்பாகச் செய்யத் தொடங்கியது…

ஆயிரக்கணக்கில் மாணவர்களும், இளைஞர்களும், பொதுமக்களும் திரள ஆரம்பித்தனர். ஒவ்வொருவரும் தங்களை பாதித்த நிகழ்வுகளை தங்களது அரசியல், சமூக, பொருளாதார, பண்பாட்டுப் புரிதலுக்கு ஏற்ப பேசத் தொடங்கினர். பேச்சு உரையாடலாக மாறியது. விவசாயிகள் மரணம், விவசாயத்துக்கு ஏற்பட்டுள்ள கடுமையான நெருக்கடி, சுற்றுச்சூழல் சீர்கேடுகள், பன்னாட்டு நிறுவனங்களின் ஒப்பந்தங்களால் சூறையாடப்படும் இயற்கை வளங்கள், அன்பொழுகக் காதல் செய்து திருமணத்தில் முடியும் வேளையில் சாதியின் பெயரால் உயிரைப் பறிக்கும் ஆணவக் கொலைகள், இதற்கு யார் காரணம்? சாதியை ஒழிக்க முடியாதா? மதத்தின் பெயரால் அரசியல் நடத்துவது சரியா?… இப்படிப் கேள்விகள் எழுப்பப்பட்டு விடைகள் தேடப்பட்டன.

இளந்தலைமுறையின் உள்ளத்தில் வீரிய கருத்துக்கள் இயல்பாகப் பதியத்தானே செய்யும். விளைவாக, விடையைக் கண்டனர். தமிழக வாழ்வாதார உரிமையை நாசமாக்கி, பண்பாட்டு விழுமியங்களை சிதைக்கும் மத்திய அரசையும் பிரதமர் மோடியையும் குற்றவாளிக் கூண்டில் ஏற்றினர். இந்த உணர்வுகளைப் புரிந்துகொள்ளத் தயாராக இல்லாத தமிழக அரசும் முதல்வரும், ஆட்சியில் இருக்கும் கட்சியின் தலைவர் என்ற வகையில் சசிகலாவும் கடுமையான நையாண்டிக்கும் விமர்சனத்துக்கும் உள்ளாகினர். இந்தப் பின்னணியில் சாதிய, பாலின வேறுபாடுகளைக் களைந்து போராட்டக் காரர்கள் அனைவரும் தங்களை யாருடன் அடையாளப்படுத்திக் கொண்டார்கள்? அங்குதான் ‘தமிழர்’ என்ற அடையாளம் வெடித்துக்கிளம்பியது.

அரசு என்றால் என்ன?

இப்படிப் போனால் பேசாமல் விட்டு விடுமா அரசு…? திரைமறைவுக் கூட்டங்கள் அரங்கேறின… ஒற்றர்கள் தூதுவர்களாக மாறுவேடம் தரித்தனர்… ஊடக வெளிச்சத்தில் குளிர் காய்ந்தவர்கள், அரசின் வெளிச்சம்பட்டதும் உருகி ஓடினர்… கோடி ரூபாய் கொடுத்துபோராட்டத்தின் நடுநாயகமாக வீற்றிருந்தவர், அரசின் பேயாட்டம் தொடங்கப் போகிறது என்பதை உணர்ந்தவுடன் அதிகார வர்க்கத்தின் இடுப்புக்கு விருட்டெனத் தாவிவிட்டார்.

உயிரையும் உணர்வையும் கொட்டி போராட்டத்தில் குதித்தவர்களோ திணற ஆரம்பித்தார்கள், வேதனையில் கண்ணீர் விட்டனர். தாங்கள் செய்ததும் செய்யத் தவறியதும் என்ன? பகைவர்கள் யார்? தோழர் கள் யார் என நெருக்கடி தொடங்கிய கண நேரத்தில் அவர்களுக்குப் புரிய ஆரம்பித்து விட்டது.

இப்படியான போராட்டங்கள் வாயிலாகத்தான் வெகுமக்கள் அரசியல் உணர்வு பெறுகின்றனர் என்பதை அதிகார வர்க்கம் உணர்ந்து வைத்துள்ளது. போராட்டத்தினூடே இளந் தலைமுறையினரும் பொது மக்களும் பெற்ற போர்க்குணம் மிக்க விழுமியங்களைச் சிதைக்க, அரசு இயந்திரம் தன் வழக்கமான ஆயுதங்களைக் கையில் எடுத்தது.

மக்கள் மீது கொடுந் தாக்குதலை நிகழ்த்து வதற்கான முன்னறிவிப்பாக ‘‘திட்டமிட்ட வன்முறை’’, ‘‘தேச விரோத சக்திகள் புகுந்து விட்டன’’ என்பது போன்ற சொல்லாடல்கள் வலிந்து உருவாக்கப்பட்டன. கடற்கரையோர மக்கள் மீது தாக்குதல்கள் கட்டவிழ்த்து விடப்பட்டன. லத்தி மட்டுமல்ல… இரும்பு பைப்புகள், கற்களையும் கொண்டு போலீஸ் தாக்கியது. கண்ணீர் புகைக் குண்டு வீச்சு… கடைகளுக்கும் வாகனங்களுக்கும் போலீஸே தீ வைப்பு என வெறிபிடித்த மிருகமாய் காவல்துறை சூறையாடலில் இறங்கியது.

சிதைக்கப்பட்ட உரிமைகளும் சீரழிக்கப்பட்ட மக்களும்:

கடல்… கடற்கரை … அகன்ற சாலைகள்… அரசு, கல்லூரி கட்டிடங்கள்… பறக்கும் ரயில்… இவற்றையெல்லாம் வாய் பிளந்துபார்த்திருப்போம்… ஆனால், இவற்றை யெல்லாம் அடுத்து ஒரு கால்வாய் ஓடுகிறது… அதையொட்டி இரு புறங்களும் ஆயிரக் கணக்கான மக்கள் வாழ்கின்றனர். நான்கடி சந்துதான் அவர்களின் பிரதான சாலை. 400 சதுரஅடிக்கு வீடிருந்தாலே, அந்தத் தெருவின் அம்பானிகள் அவர்கள்.போராடிய மாணவர்களுக்கு சோறு பொங்கிப் போட்டதற்காக இம்மக்களின் குடியிருப்புகளுக்குள் போலீஸ் படையெடுத் துப் போனது. ஆண் காவலர்கள் தங்களின் பேண்ட் ஜிப்பை கழற்றி ஆணுறுப்பை காண்பித்து, மொழியே கூச்சப்படும் அத்தனை வார்த்தையையும் கொட்டித் தீர்த்துள்ளனர்.

‘‘அந்தப் போலீஸ்கார பையன்கல்லாம் என் புள்ளயவிட சின்ன வயசுப் பசங்க. பொங்கிக்கொண்டிருந்த சோத்து குண்டான எட்டி ஒதச்சாணுங்கப்பா… முட்டையா அவிச்சுகொடுத்த… என கத்திக்கொண்டே 75 முட்டை யை என் தல மேல போட்டு அடிச்சானுங்க…’’ ‘‘சாவு போஸ்டர் ஒட்டிக் கொண்டி ருக்கும்போது, எங்க அண்ணன போலீஸ் சூழ்ந்துகிட்டு அடிஅடின்னு அடிச்சானுங் கண்ணா… தடுக்கப் போன என்னையும் அடிச்சானுங்கண்ணா… உங்கள அண்ணனா நெனச்சு காண்பிக்கிறேன்…’ என்று சொல்லிக் கொண்டே தனது இடது காலைக் காட்டினார்… வெறிநாய்கள் கவ்வினால்கூட அப்படி இருக் காது… அந்தச் சகோதரியின் கால் முழுவதும் காயங்களால் கன்னிப் போயிருந்தன.

‘‘வீட்டில் தூங்கிக் கொண்டிருந்த என் ரெண்டு பிள்ளய இழுத்துப் போட்டு அடிச்சானுங்க. ஒருத்தன் மண்டை ஒடஞ்சு ரத்தம் வந்துச்சி. ஏண்டா என் புள்ளய அடிக்கிறீங்கன்னு கேட்டதுக்கு, என் மண்டையையும் ஒடச்சுட்டானுங்கப்பா…’’ என்றபடியே தையல் போட்ட இடத்தை காட்டினார் ஒரு தாய். இவர்களில் பலருக்கு ராயப்பேட்டை அரசு மருத்துவமனையில் தையல் போட்டு, எக்ஸ்ரே எடுத்துள்ளனர். ஆனால், சிகிச்சை எடுத்ததற்கான எந்த அத்தாட்சி ரசீதும் கொடுக்கவில்லை. சிகிச்சை அளித்த நாளில் அரசு ஆதாரம் எதையும் தந்துவிடக் கூடாதே…! இப்படி ரத்தம் கொதிக்க வைக்கும் கொடுமைகளுக்கு உள்ளாகியுள்ளனர் நூற்றுக்கணக்கான அப்பாவி மக்கள். நம் நாட்டில் எப்போதும் வன்முறைக்கு ஆளாகும் தாழ்த்தப்பட்ட, பிற்படுத்தப்பட்ட அன்றாடங் காய்ச்சி மக்கள்தான் இவர்கள். இது மட்டுமா… போராட்டத்தை முடிவுக்குக் கொண்டுவர வேண்டுமென அரசு முடிவெடுத்த ஜனவரி 23ஆம் தேதி தலைமைச் செயலகம் தொடங்கி பட்டினப்பாக்கம் வரை மேற்கே ஜெமினி பாலம்வரை கண்ணுக்குப்பட்டவர் களையெல்லாம் லத்தியால் அடித்து, கேள்வி கேட்டவர்களையெல்லாம் கைது செய்தது போலீஸ். கைதானவர்களை குண்டுக் கட்டாய் தூக்கிக்கொண்டு பல போலீஸ் ஸ்டேஷன்களுக்கு அள்ளிச் சென்றுள்ளனர். அங்கு கண்மண் தெரியாமல் தாக்கியுள்ளனர். கடற்கரை அருகே இருந்த காவல் நிலை யங்களில் எல்லாம் போலீஸ் தாக்குதலை தாங்க முடியாமல் கதறும் குரல்கள் காற்று வெளியெங்கும் பரவ ஆரம்பித்திருந்தன. அன்றைய தினம் சென்னை மாநகரம் மீண்டும் ஒரு முறை நெருக்கடி நிலையை உணர்ந்தது.

சிகிச்சைக்கும் சிறுநீர் கழிப்பதற்கும் ஒரு போராட்டம்:

இப்படியாய்… ஒரு குரல் வழியாகதான் மயிலாப்பூர் காவல் நிலையத்திற்கு ஜனவரி24ஆம் தேதி சென்றிருந்தேன். நடந்த சம்பவங்களுக்கு நேரடியாகச் சம்பந்தமில்லாமல் அங்கு பிடித்து வைக்கப்பட்டிருந்த 29 பேரை எழும்பூர் 13ஆவது நீதிமன்றத்தில் காவல்துறை ஆஜர்படுத்தியது. வழக்கறிஞர்கள் பிரதாபன், திருமூர்த்தி உள்ளிட்டோர் காவல் துறையின் தாக்குதலை எடுத்துரைத்தனர். நீதிபதி கோபிநாத் காவல் துறையைக் கண்டித்ததோடு, அவர்களை சிறைக்கு அனுப்பாமல் மருத்துவ சிகிச்சைக்கு அனுப்ப போலீசுக்கு உத்தரவிட்டார். இரண்டு வாகனங்களில் 29 பேரை ராயப்பேட்டை அரசு மருத்துவமனைக்கு அழைத்துவந்த போலீஸ், அங்கு சிகிச்சை கொடுக்காமல் காலம் கடத்தியது. மார்க்சிஸ்ட் கம்யூனிஸ்ட் கட்சி தலைவர் உ.வாசுகி தலை மையில் 20-க்கும் மேற்பட்ட வழக்கறிஞர்கள் கொடுத்த நிர்ப்பந்தம் காரணமாக அவசர சிகிச்சைப் பிரிவுக்கு அவர்கள் அழைத்துச் செல்லப்பட்டனர். இவர்களைச் சிறையில் அடைப்பதற்கு வசதியாக (Fit for remand) எழுதிக் கொடுங்கள் என்று அங்கிருந்த மருத்துவரிடம் ஒரு காவலர் வற்புறுத்தினார். ‘‘நீங்கள்உங்கள் கடமையை செய்யுங்கள்.
போலீஸ் சொல்வதை கேட்டால், சட்டத்தின் முன் விபரீத விளைவுகளை சந்திப்பீர்கள்’’ என மருத்து வரை நோக்கி வாசுகி எச்சரித்தார். போலீஸ் காரரைப் பார்த்து கோபத்துடன், ‘‘இதுதான் உங்கள் காவல்துறையின் லட்சணமா?’’ எனக் கேட்டார். அதன் பின்னரே சிகிச்சைகள் தொடங்கின. அப்போதும் வாகனத்திற்குள் நுழைந்து ‘‘அடியெதுவும் இல்லை… வலிக்கவில்லை’’ என மருத்துவரிடம் சொல்லச் சொல்லி பிடிபட்டிருந்தவர்களிடம் போலீஸ்காரர்கள் வற்புறுத்த ஆரம்பித்தனர். சிறுநீர் கழிக்கக்கூட வாகனத்திலிருந்து இறக்கிவிடவில்லை. அதற்கும்கூட வழக்கறிஞரை வைத்து நிர்ப்பந்தப்படுத்தி சிறுநீர் கழிக்க வேண்டும் என்ற உரிமையைப் பெற வேண்டியதாயிருந்தது. பரிசோதனைக்குப் பிறகு 29 பேரில் 3 பேருக்கு கை, கால் முறிவு, 9 பேருக்கு கொடுங்காயம், மற்ற அனைவரின் உடம்புகளும் காயங்களால் நிறைந்திருந்தன என மருத்துவர்கள் எழுதிக் கொடுத்தனர். இதில் ஒருவரை உள்நோயாளியாகச் சேர்த்து, நள்ளிரவில் நீதிபதியிடம் அனுமதி பெற்று மற்ற அனை வரையும் சிறையில் அடைத்தது காவல்துறை.

‘கைது செய்யப்பட்டவர்கள் அனைவரும் சமூக விரோதிகள்’, ‘கைதுப் படலம் தொடரும்’ என எழுதி வைத்திருந்ததை ஊடகங்கள் முன்னால் வாசித்துவிட்டு இறுகிய முகத்தோடு வெடுக்கென சென்றார் சென்னை போலீஸ் கமிஷனர் ஜார்ஜ். யார் யார் எங்கு கைது செய்யப்பட்டார்கள்? அவர்களின் பெயர்கள் என்ன? வழக்கு விபரம் என்ன? எந்தத் தகவலையும் இதுவரை வெளிப்படையாக தெரிவிக்காமல் கைது செய்யப்பட்ட தகவலை ரத்த உறவினர்களுக்குக்கூட சொல்லாமல், உச்ச நீதிமன்றத் தீர்ப்பின் வழிகாட்டுதலை காலில் மிதித்து நசுக்கியிருக்கிறது சென்னை மாநகர காவல் துறை.

மாணவர் எழுச்சியை நிலப்பிரபுத்துவ எதிர்ப்பு ஏகாதிபத்திய எதிர்ப்பு
 விவசாய தேசிய இயக்கமாக முன்னெடுப்போம்.

* மெரினா மாணவர் எழுச்சி ஜல்லிக்கட்டுக்கான போராட்டம் மட்டுமல்ல. மோடி அரசின் மக்கள் விரோதக் கொளகைகளை எதிர்த்த அனைத்து மக்களின் போராட்டத்தின் தொகுப்பேயாகும்!

* ஜல்லிக்கட்டுக்கான மாணவர், இளைஞர் போராட்டம் , ஜல்லிக்கட்டு நடத்துவதற்கான தமிழக சட்டமன்றத்தில் கொண்டுவந்துள்ள சட்டத்திருத்தத்தின் மூலம் வெற்றிப்பெற்றுள்ளது. அதற்காக தீரமாக போராடிய மாணவர் – இளைஞர்களை பாராட்டுகிறோம். வாழ்த்துகிறோம்!

*அதேசமயம், மாணவர்களின் எழுச்சியை அடக்கும் நோக்கத்துடன் மோடி அரசும், தமிழக அரசும் இறுதி கட்டத்தில் அடக்குமுறைகளை கட்டவிழ்த்து விட்டுள்ளன. இத்தகைய மக்கள் எழுச்சி இனி ஏற்படக் கூடாது என்று திட்டமிட்டே காட்டுமிராண்டித்தனமான தாக்குதலை தமிழக காவல் துறை தொடுத்துள்ளது. இத்தகைய அடக்குமுறைகளை வன்மையாகக் கண்டிக்கிறோம்!

*தமிழக சட்டமன்றத்தின் சட்டத் திருத்தத்திற்குப் பிறகு ஜல்லிக்கட்டுக்கான போராட்டத்தின் ஒரு கட்டம் முடிவு பெற்றுள்ளது. ஜல்லிக்கட்டுக்கு நிரந்தரமாகத் தடையை நீக்க மறுத்து மத்திய அரசோ,

உச்சநீதிமன்றமோ முடிவு செய்தால் மீண்டும் போராட்டம் நடத்துவோம்!

*ஜல்லிக்கட்டு போராட்டம் தமிழர் தேசிய பண்பாட்டுக்கான போராட்டம் என்று சொன்னால் (மட்டும் Ed) போதாது. உண்மையில் தமிழர்களின் பொதுவான பண்பாட்டு இயக்கமாக ஜனநாயகப்படுத்தப்பட வேண்டும்.

 

* ஜல்லிக்கட்டு போராட்டம் (Ed), ஏகாதிபத்திய எதிர்ப்பு, நிலவுடமை எதிர்ப்பு என மாணவர் எழுச்சியாக தொடர வேண்டும்!

வர்க்கங்களின் சாதி ஆதிக்கத்தில் உள்ள பண்பாட்டை ஒரு பொதுப் பண்பாடாக, அனைத்து சாதியினரையும் உள்ளடக்கிய, ஆணாதிக்கத்தை ஒழிக்கக் கூடிய ஜனநாயகப்

 ஜல்லிக்கட்டு நடத்துவதற்கான நிரந்தர சட்டம் கோரி சென்னையில் போராட்டத்தில் ஈடுபட்டவர்களை காவல் துறையினர் வலுக்கட்டாயமாக வெளியேற்றியதாகக் கூறப்படுவது தொடர்பாகவும், ஊடகங்களில் வெளியானதாக சொல்லப்படும் காவல் துறையினரே குடிசைகளுக்கு தீ வைத்தது, வாகனங்களை கொளுத்தியது போன்ற நிகழ்வுகள் தொடர்பாக விளக்கம் அளிக்க வேண்டும் எனவும் தமிழக அரசுக்கு தேசிய மனித உரிமைகள் ஆணையம் நோட்டீஸ் அனுப்பியுள்ளது.

கடந்த ஒரு வாரமாக, தமிழகத்தில் ஜல்லிக்கட்டு நடத்தக்கோரி மாநிலம் முழுவதும் மாணவர்கள் மற்றும் பொதுமக்கள் தொடர் போராட்டத்தில் ஈடுபட்டனர். ஜல்லிக்கட்டு நடத்துவதற்கான சட்டம் நிறைவேற்றப்பட்டதால் பல இடங்களில் போராட்டக்காரர்கள் தங்களது போராட்டத்தை வாபஸ் பெற்றனர். இருந்த போதும், மெரினாவில் போராட்டத்தில் ஈடுபட்டவர்கள் சிலர் நிரந்தர சட்டம் நிறைவேறும் வரை போராட்டம் தொடரும் என்று அறிவித்து அங்கிருந்து வெளியேற மறுத்தனர்.

 

இந்த விவகாரம் குறித்து தேசிய மனித உரிமைகள் ஆணையம் அளித்துள்ள செய்தி அறிக்கையில், ''சென்னை மெரினா கடற்கரையில் போராட்டத்தில் ஈடுபட்டவர்களை காவல்துறை அப்புறப்படுத்தும் போது மேற்கொண்ட நடவடிக்கைகளையின் போது ஏற்பட்ட வன்முறையில் மாணவர்கள் தங்களது உயிரை காப்பாற்றிக்கொள்ள ரத்தம் வழிய ஓடிய காட்சிகள், காவல் துறையினர் பலரின் வீடுகளுள் சென்று மக்களை கடுமையாக தாக்கியது போன்ற காட்சிகள் தொலைக்காட்சிகளில் கண்ணபிக்கப்பட்டன. இது குறித்த விளக்கம் அளிக்க வேண்டும்,'' என்று தெரிவிக்கப்பட்டுள்ளது.
 

வன்முறை ஏற்பட்டபோது காவல் துறையினர் எடுத்த நடவடிக்கைகள் என்ன என்பது குறித்தும்,இரண்டு வாரங்களுக்குள் பதில் அளிக்க வேண்டும் என தமிழக தலைமைச் செயலர் மற்றும் காவல் துறை இயக்குநர் ஆகியோருக்கு தேசிய மனித உரிமைகள் ஆணையம் நோட்டீஸ் அனுப்பியுள்ளது.
