நீதிபதி குன்ஹா தீர்ப்பு: 10 முக்கியக் குறிப்புகள்!

ஜெயலலிதா வழக்கில் பெங்களூர் தனி நீதிமன்ற நீதிபதி மைக்கேல் டி குன்ஹா அளித்த 1,232 பக்க முழு தீர்ப்பையும் பெற்றுள்ள ‘தி இந்து’, அதன் முக்கியமான 10 அம்சங்களை இங்கே சுருக்கி அளிக்கிறது.

1. பூதமாக வளர்ந்த சொத்துகள்!

ஜெயலலிதா தனது முதல்வர் பதவிக்காலத்தை (1991-1996) தொடங்கும்போது அவரது சொத்து மதிப்பு ரூ. 2.18 கோடி. இதில் அவர் பங்குதாரராக இருந்த ஜெயா பப்ளிகேஷன்ஸ், சசி என்டர்பிரைசஸ் சொத்துகளும் அடங்கும். பதவிக்காலத்தில் அவருடைய சட்டப்பூர்வமான வருமானம் ரூ.9.91 கோடி. ஆனால், பதவிக்காலத்தின் முடிவில் அவருடைய சொத்து மதிப்பு ரூ.53. 60 கோடி. இந்த மதிப்பு 1991-96-ல் இந்த வழக்கின் எதிரிகள் என்ன விலைக்கு வாங்கினார்களோ அந்த மதிப்புக்குத்தான் கணக்கிடப்பட்டுள்ளது.

2. கணக்கு காட்ட முடியவில்லை!

முதல்வராகப் பதவியேற்ற முதல் 27 மாதங்களில் மாதம் வெறும் ஒரு ரூபாய் மட்டும் அடையாள வருமானமாக ஜெயலலிதா பெற்றிருக்கிறார். நடிகை என்ற வகையில் அவர் சொத்து சேர்த்திருக்க முடியும் என்றாலும், அவர் பெயரிலான சொத்துகளுக்கு விளக்கம் தர அது போதுமானதாக இல்லை. அவருடன் சேர்த்து குற்றஞ்சாட்டப்பட்ட இதர 3 எதிரிகளும் எந்த வேலைக்கும் செல்லவில்லை, அவர்களுக்கென்று ஊதியமும் இல்லை.

3. நம்ப முடியவில்லை மூவரின் நடவடிக்கைகள்!

சொத்துகளை வாங்குவதற்கான பணம் ஏனைய மூன்று பேரிடமிருந்துதான் வந்தது, ஜெயலலிதாவுக்கு அதைப் பற்றி எதுவும் தெரியாது என்று ஜெயலலிதா தரப்பில் வாதாடப்பட்டது. முதலமைச்சராக இருக்கும் ஜெயலலிதாவுக்குத் தனது வீட்டிலேயே வசிக்கும் மூன்று பேருடைய நடவடிக்கைகள் தெரியாது என்பதை நம்ப முடியவில்லை. அந்த மூன்று பேருக்கும் வருமானம் ஏதும் கிடையாது என்னும்போது அது ஜெயலலிதாவுடைய பணம்தான் என்ற முடிவுக்கு வர வேண்டியிருக்கிறது.

4. மூன்று பேரின் பங்கு!

சுதாகரனும் இளவரசியும் 1991 முதல் 1996 வரையில் ஆறு நிறுவனங்களில் இயக்குநர்களாகச் சேர்ந்துள்ளனர். 1991 முதலே இந்த நிறுவனங்கள் இருந்தாலும் எதிரிகள் இதில் சேர்ந்த பிறகுதான் வங்கிக் கணக்குகள் தொடங்கப்பட்டன. இதே காலத்தில் ஏற்பட்ட 18 நிறுவனங்களில் குறிப்பிடத் தக்க வரவு-செலவு நடவடிக்கைகள் ஏதும் நடைபெறவில்லை. ஆனால், பெரிய அளவில் நிலங்கள் வாங்கப்பட்டுள்ளன. அதற்கான பணம் ஜெயா பப்ளிகேஷன்ஸ் என்ற நிறுவனத்திலிருந்து தரப்பட்டிருக்கிறது.

5. பணம் அள்ளிவிடப்பட்ட ஆடம்பரத் திருமணம்!

திருமணத்துக்கு முன்னதாக சுதாகரனை வளர்ப்பு மகன் என்று ஜெயலலிதாவே அறிவித்திருக்கிறார். திருமணத்துக்காகப் பந்தல் அமைத்தது முதல் திருமணச் சடங்குகளை நடத்தியது, திருமணத்துக்கான பொருட்களை வாங்கியது என்று எல்லாவற்றுக்கும் ஜெயலலிதாதான் செலவிட்டிருக்கிறார். பெண்ணின் தகப்பனார் 14 லட்ச ரூபாய் செலவு செய்திருக்கிறார். திருமணத்துக்கு நான் செலவிடவில்லை என்று ஜெயலலிதா கூறியிருந்தாலும், 1996-97-ம் ஆண்டுக்கான வருமான வரிக் கணக்கில் திருமணத்துக்காக ரூ.29.92 லட்சம் செலவிட்டதாகக் கணக்கு காட்டியிருக்கிறார். எல்லா மூல ஆவணங்களும் ரசீதுகளும் காசோலைகளும் ஜெயலலிதாவின் தணிக்கையாளரிடமிருந்து பறிமுதல் செய்யப்பட்டுள்ளன. இவற்றிலிருந்தே முழுச் செலவையும் அவர்தான் செய்திருக்கிறார் என்பது நிரூபணமாகிறது. திருமணத்துக்கு அழைக்கப்பட்டவர்கள் எண்ணிக்கை, விருந்து சாப்பிட்டவர்களின் எண்ணிக்கையைப் பார்த்தால், திருமணச் செலவு ரூ.6.45 கோடியைக்கூடத் தாண்டியிருக்கும் என்றாலும், ஜெயலலிதாவின் பங்குக்குச் செய்யப்பட்ட செலவு எப்படியும் ரூ.3 கோடி இருக்கும்.

6. செருப்பு, புடவைகள் கணக்கு என்ன?

ஜெயலலிதாவின் வீட்டில் 386 ஜோடி செருப்புகள், 914 பட்டுப்புடவைகள், 6,195 இதர புடவைகள், 2,140 பழைய புடவைகள், இதர ஆடைகள் ஆகியவை தொடர்பாக ஊழல் தடுப்பு இயக்குநரகம் அளித்த கணக்கு தள்ளுபடிசெய்யப்படுகிறது. இவையெல்லாம் ஜெயலலிதா முதல்வராக இருந்தபோதுதான் வாங்கினார் என்பதற்கு ஆதாரங்கள் இல்லை. அதேவேளையில், மொத்தமிருந்த 27.588 கிலோ தங்க நகைகளில் சுமார் 20 கிலோ வருவாய்க்குப் பொருந்தாதவை.

7. கருணைக்கு வழி இல்லை!

இந்த வழக்கு அரசியல் எதிரிகளால் புனையப்பட்டது என்றும் 18 ஆண்டுகள் கடந்துவிட்டது என்றும் இந்தக் காலகட்டத்தில் மன உளைச்சலும் வேதனையும் அடைந்திருப்பதாக குற்றஞ்சாட்டப்பட்டவர்கள் தெரிவித்துள்ளனர். இந்த வழக்கு தொடரப்பட்ட பிறகு, ஜெயலலிதா 11 ஆண்டுகளாக முதலமைச்சராக இருந்துவருவதாகவும் இப்போது அவர் மீது எந்தக் குற்றச்சாட்டும் இல்லையென்றும் வாதிட்டுள்ளனர். மேலும், உடல்நலக்குறைவு காரணமாகக் கருணை காட்டுமாறும் கோரியுள்ளனர். இந்தக் காரணங்கள் எதுவும் கருணை காட்டுவதற்கு ஏற்றவை அல்ல. இந்த வழக்கு 18 ஆண்டுகளாகத் தாமதமானதற்கு யார் காரணம் என்று இப்போது ஆராய வேண்டியதில்லை. நீதியைக் குழிதோண்டிப் புதைக்க முயற்சி நடப்பதாகக் குற்றச்சாட்டு எழுந்ததால்தான், வழக்கு விசாரணை பெங்களூருக்கு மாற்றப்பட்டது. 5 ஆண்டுகளுக்கு வழக்குக்குத் தடை இருந்ததிலும் சந்தேகம் இல்லை. ஆனால், அதன் பிறகும் குற்றவாளிகள் சட்ட நடைமுறைகளைத் தங்களுக்குச் சாதகமாகப் பயன்படுத்தி, கணிசமான நேரத்தை வீணடித்தனர். குற்றச்சாட்டு பதிவுசெய்யப்பட்ட நேரத்தையும் வாக்குமூலம் பதிவு செய்யப்பட்ட நேரத்தையும் தவிர, பிற நாட்களில் குற்றவாளிகள் ஆஜராகவில்லை. எனவே, வழக்கு நிலுவையில் இருந்ததால் தாங்கள் மனவேதனை அடைந்ததாக அவர்கள் கூறுவதை ஏற்க முடியாது.

8. கனிவுக்கு வழியில்லை!

ஊழல் செய்த அரசு ஊழியருக்கு ஓராண்டுக்குக் குறையாமலும், 7 ஆண்டுகளுக்கு மிகாமலும் சிறைத் தண்டனையும் அபராதமும் விதிக்க ஊழல் தடுப்புச் சட்டத்தின் 13(2)வது பிரிவு வகை செய்கிறது. அதைப் பயன்படுத்த வேண்டியுள்ளது. மிக உயர்ந்த பதவியில் இருந்துகொண்டு ஜெயலலிதா இந்தச் செயலில் ஈடுபட்டதுதான் குற்றத்தின் தன்மையை அதிகரிக்கிறது. ‘மன்னன் எவ்வழி, மக்கள் அவ்வழி’ என்று பழமொழியுள்ளது. உயர் பதவியில் இருப்பவர்களின் தவறுகள் மீது கனிவோ இரக்கமோ காட்டினால், அது ஒட்டுமொத்த சமூக வாழ்க்கைக்கும் கேடாக முடியும் என்று கர்நாடக உயர் நீதிமன்றம் ஒரு வழக்கில் தீர்ப்பளித்திருக்கிறது. எனவே, இந்த வழக்கில் கனிவுக்கோ அனுதாபத்துக்கோ இடமில்லை.

9. தண்டனையின் அளவுகோல்!

குற்றத்தின் தீவிரம், சொத்துகளின் மதிப்பு, அவை பெறப்பட்ட முறை ஆகியவற்றின் அடிப்படையில்தான் தண்டனையைத் தீர்மானிக்க முடியும். அப்படிப் பார்க்கும்போது, இது கடுமையான தண்டனைக்குரியது. சட்டம் வழங்கியுள்ள அதிகபட்ச தண்டனையில் (7 ஆண்டுகள்) பாதிக்குமேல் விதித்தால்தான் நீதி நிலைநாட்டப்படும் என்பதால், நான்கு ஆண்டுகள் விதிக்கப்படுகிறது.

10. ஊழலை எப்படி அளவிடுவது?

ஊழலை அளவின் அடிப்படையில் தீர்மானிக்கக் கூடாது. ஊழல்தான் ஒழுங்கீனத்தின் தாய். அது சமூக முன்னேற்றத்தை அழிக்கிறது, தகுதியற்ற ஆசைகளை வளர்க்கிறது, மனசாட்சியைக் கொல்கிறது, மனித நாகரிகத்தையே குலைக்கிறது!

Pakistan and India have exchanged fire with each other across the border in the disputed region of Kashmir with gunfire and mortar shells, killing civilians, as both sides claim their troops were retaliating to provocations.

At least five people died and 29 were injured in unprovoked firing overnight on Monday by Pakistani troops in Arnia sector in India-administered Kashmir, according to an Indian army spokesperson.

Meanwhile, Pakistan claimed that Indian troops killed at least four civilians, including two children, and injured five others in unprovoked gunfire in Sialkot in Pakistan-administered Kashmir. Pakistan said its troops only responded to the attack.

Rajnath Singh, India's interior minister, warned Pakistan on Monday to stop ceasefire violations on the shared border in Kashmir as with the new government in power "the state of affairs is no longer the same as it was some time back".

India claimed Kashmir has witnessed almost uninterrupted ceasefire violation by Pakistan since August 15.

Mukhtar Abbas Naqvi, the vice president of the ruling Bharatiya Janata Party (BJP), also warned Islamabad to be careful.

"These repeated ceasefire violations by Pakistan are a matter of great concern and Pakistan should understand that this kind of behaviour is not good for her health," said Naqvi.

Blame game

Soldiers from the arch rivals intermittently exchange fire on the Line of Control (LoC) despite an agreement in 2003 that a ceasefire should be observed along the working boundary.

In 2013, more than 200 ceasefire violations were recorded on the LoC, the highest in the last decade.

The Himalayan region of Kashmir has been a bone of contention between India and Pakistan since both gained independence in 1947.

They have fought three wars and came close to a fourth in 2001.

India has for years complained that Pakistan backs separatists who slip in from Pakistan-administered Kashmir to stage attacks.

Pakistan says it only gives political support to the people of Kashmir, who it says face human rights abuses at the hands of Indian troops, a claim New Delhi denies.

Shocking revelations have come to the fore on how hundreds of bodies of Sri Lanka’s migrant workers in Middle East countries had been brought back to the country each year, although the numbers had been kept as a ‘top’ secret by the Sri Lanka Bureau of Foreign Employment (SLBFE) and the Ministry of External Affairs (MEA).

In 2014 alone, up to end September, 350 bodies had be brought to the country of which figure, 202 had been from Saudi Arabia and other Middle Eastern countries while 148 bodies had been sent from other countries. UNP Parliamentarian, Ranjan Ramanayake, had challenged Foreign Employment Promotion and Welfare Minister, Dilan Perera, to reveal the truth behind the increasing number of deaths of migrant worker in Middle East countries.

Although the SLBFE or the External Affairs Ministry do not release data pertaining to those who had died while being employed abroad, MP Ramanayake told The Sunday Leader that, it had become a serious issue as the number of bodies of migrant workers that are being brought back to Sri Lanka is on the rise.

“This cannot be considered as a minor issue. Up to now, we have not heard of more than 10 migrant workers who had died over the past several years although we know that our migrant workers are subjected to much harassment by their employers.

But it is shocking to know that many of them had died mysteriously, especially as they had toiled hard to earn foreign exchange for the country, and are being brought back in sealed coffins.

SLBFE and MEA numb

“Why wasn’t this bad trend brought to the notice of our people? If that had been done, those who still want to go abroad to earn money with the intention of leading a comfortable life thereafter, would think twice before they leave the country on employment. However, I want to know what action had been taken by the SLBFE and the External Affairs Ministry against the employers of these unfortunate persons, over their mysterious deaths?” Ramanayake questioned.

“I wonder how many job agencies had been blacklisted by the SLBFE for sending these workers to places that have proved to be unsafe?” he further asked.

Meanwhile, reliable sources from the Bandaranaike International Airport (BIA) Katunayake, on grounds of anonymity, confirmed Ramanayake’s claim, and added that, 350 bodies had been brought back to the country for the period January 1, 2014 up to end September.

According to sources, 227 male and 123 female bodies had been sent back to the country during this period, out of which 65 bodies were from Saudi Arabia while 135 bodies were from other Middle Eastern countries including Lebanon, Jordan and Kuwait.

“Another 148 bodies had been returned from other countries, and we believe there could be migrant workers as well among them,” sources added.

Statistics on the rise

They further said that according to statistics collated in the past three years, the number of bodies returning to the country had gone up, and went on to say that the majority of them are of migrant workers.

“In 2012, 462 bodies had been brought to the country; of this figure, 190 were of males while 172 were of females. In 2013, 480 bodies had been brought to the country,” sources claimed.

Sources were also critical of the SLBFE and the MEA for not conducting inquiries into these deaths as the causes of death given in the death certificates of the deceased were deemed to be suspicious.
“The cause of death of 99 per cent of the unfortunate victims had been cited as being due to ‘cardiac and respiratory arrest’ while one per cent states the cause of death as ‘suicide.’ How can all these young migrant workers get cardiac arrest when they have not shown sings of any illness before they left the country?” sources demanded to know.

“When we spoke to the families of the deceased, it was revealed that all of them had complained of ‘harassment’ meted out by their employers. Although these issues had been brought to the notice of the job agents and the SLBFE, nothing had been done to safeguard the unfortunate migrant workers until they had met with untimely deaths,” sources alleged.

Meanwhile, Ramanayake further accused the SLBFE and the subject minister, Dilan Perera, for having spent the money they obtain from the migrant workers prior to their departure, to hold reality shows without using the same for the welfare of the migrant workers or their families.

“One of Sri Lanka’s foremost foreign exchange earners is the migrant worker. The SLBFE earns enormous revenue from the workers but it had never spent any money on their welfare or that of their families. What has the SLBFE given to the families of the deceased migrant workers? When I spoke to the grieving families, I came to know that not even 0.1 per cent had received any benefit from the SLBFE,” Ramanayake charged.

According to him, all the families had received only Rs.10,000 from ‘Sahana Piyasa,’ – a welfare scheme, but nothing from the SLBFE, per se.

Workers’ money squandered

“The income of the SLBFE exceeds US$ Eight billion but on what do they spend the money? Instead of spending money on the migrant workers and seeing to the welfare of their families, millions of rupees are spent on reality shows,” Ramanayake claimed.

“I have visited many Middle Eastern employers in their respective countries, and they had openly stated that women migrant workers are mainly taken to be sex slaves although they are employed as housemaids.

The wives of these employers do not seem to mind their husbands having sex with our migrant workers as they do not want their husbands to marry another woman as this would cost them a tidy sum of money. The wives of these employers do not want their husbands to spend money on another wife.

Therefore they allow them to have sex with the housemaids. Because of these issues, Sudan, Ethiopia, Nepal, Bangladesh, India and Pakistan had stopped sending women from their countries for employment overseas as domestic aides,” Ramanayake said.

Foreign Employment Insurance and Welfare Scheme

The document pertaining to the Foreign Employment Insurance and Welfare Scheme clearly states that migrant workers who are repatriated due to harassment, illness, accident or injury after leaving for employment abroad, are entitled to receive the actual cost of a one-way air ticket, without taxes, and medical expenses amounting to Rs. 25,000.

According to this document, the migrant worker will be entitled to this benefit even after three months of the contract period expiring, while she is still abroad. It further states, “If the worker returns due to pregnancy as a result of sexual harassment by the sponsor or his family members whilst working abroad during the contract period, she is still entitled to medical expenses up to Rs 25,000 she would have incurred after returning to Sri Lanka, and the actual cost of a one-way air ticket. However, a worker who runs away from her place of employment is not entitled to this facility.

In case of death due to any cause whilst working abroad and the SLBFE certifies the cause of death as ‘homicide’ according to the evidence available, the legal heirs of the deceased worker will be entitled to receive Rs.400,000 even though the death certificate would state the cause of death as suicide.

“In case of death in Sri Lanka within three months of arriving due to a critical illness borne by the worker from the time s/he was insured, and if an accident would have occurred while working abroad during the contract period, the legal heirs are entitled to receive Rs. 200,000.

Although the legal heirs of the deceased migrant worker are entitled to such benefits, the family members of some of the deceased workers confirmed to The Sunday Leader that they did not receive any compensation or any other benefit from an insurance company or from the SLBFE. All they had received was a mere Rs.10,000 from ‘Sahana Piyasa.’

வளர்ச்சியடையக்கூடிய வாய்ப்புகள் இருந்தும், இன்னமும் முறையாக வளர்ச்சியடையாத மாகாணசபை பாடசாலைகளை, தேசிய கல்லூரிகளாக சீரமைக்கும் திட்டத்தின் அடிப்படையில் கொழும்பு மாவட்டத்தின் சில மாகாணசபை பாடசாலைகள், மத்திய அரசினால்  சுவீகரிக்கப்படுகின்றன.

இவற்றில் தற்போது சிங்கள பாடசாலைகள் தெரிவு செய்யப்பட்டுள்ளன. இந்நிலையில் கொழும்பின் தமிழ் பாடசாலைகளான, கணபதி இந்து மகளிர் வித்தியாலயத்தையும், வடகொழும்பு இந்து கல்லூரியையும் இந்த பட்டியலில் சேர்த்துக்கொள்ள வேண்டும் என்ற ஜமமு தலைவர்  மனோ கணேசனின் கல்வி அமைச்சர் பந்துல குணவர்தனவிடம் கோரியுள்ளார்.

இக்கோரிக்கையை சாதகமாக பரிசீலிப்பதாக உறுதியளித்த, அமைச்சர் இது தொடர்பில் எழுத்து மூல விபரங்களை உடன் அனுப்பி வைக்கும்படியும் கேட்டுக்கொண்டுள்ளார்.  

மேற்படி கோரிக்கையையடுத்து, அமைச்சரின் வேண்டுகோளுக்கு இணங்க கல்வி அமைச்சருக்கு அனுப்பி வைக்கப்பட்டுள்ள எழுத்து மூலமான ஆவணத்தில் பின்வருமாறு தெரிவிக்கப்பட்டுள்ளது.

ஜனத்தொகை கணக்கெடுப்பின் அடிப்படையில் கொழும்பு மாவட்டத்தில் வாழும்  258,655 தமிழர்களில் சுமார்  70 விகிதமானோர் கொழும்பு மாநகரில் வாழ்கின்றார்கள்.

கொழும்பு மாநகரில் வாழும் தமிழர்களில் 60 விகிதமானோர், அதாவது 106,325 பேர் வட கொழும்பு, மத்திய கொழும்பு ஆகிய இரண்டு தொகுதிகளில் மாத்திரம் வாழ்கிறார்கள்.

இந்நிலையில் பாரம்பரியமாக தென் கொழும்பு பகுதியிலேயே வளர்ச்சியடைந்துள்ளதாக கருதப்படும் பிரபல தேசிய தமிழ் பாடசாலைகள் அமைந்துள்ளதால், அரசாங்க பாடசாலைகளை நாடும் மத்திய வருமானம் கொண்ட தமிழ் பெற்றோர்கள் இப்பாடசாலைகளில் தமது பிள்ளைகளை சேர்த்திட பெரும்பாடு படுகிறார்கள்.

எனவே தமிழர்கள் கொழும்பில் அதிகம் வாழும் வடக்கு, மத்திய கொழும்பு வலயத்தில் இன்னமும் இரண்டு தேசிய தமிழ் பாடசாலைகளை உருவாக்கி தரும்படி கேட்டுக்கொள்கிறேன்.

வடமாகாணத்தில் 3 மாவட்டங்களில் மட்டும் தமிழ் மக்களுக்குச் சொந்தமான சுமார் 28,316 ஏக்கர் நிலம் ஆக்கிரமிக்கப்பட்டுள்ள நிலையில், இந்த நிலத்தில் பூர்வீகமாக வாழ்ந்த தமிழ் மக்கள் இடம்பெயர்ந்து உறவினர், நண்பர்கள் வீடுகளிலும் நலன்புரி முகாம்களிலும் வாழ்ந்து கொண்டிருப்பதாக தமிழ்த் தேசியக் கூட்டமைப்பின் வடமாகாண சபை உறுப்பினர்கள் தெரிவித்துள்ளனர்.

மாகாண சபையில் எதிர்வரும் 9 ஆம் திகதி நில சுவீகரிப்பு மற்றும் நில ஆக்கிரமிப்பு நடவடிக்கைகள் தொடர்பில் ஆராய்வதற்கான விசேட அமர்வு நடைபெறவுள்ள நிலையில், முதற்கட்டமாக திரட்டப்பட்ட தகவல்களினடிப்படையில் கிளிநொச்சி, முல்லைத்தீவு, யாழ்ப்பாணம் ஆகிய 3 மாவட்டங்களில் மேற்படி அளவு நிலம் சுவீகரிக்கப்பட்டுள்ளதாகவே இவர்கள் கூறுகின்றனர்.

இவ்விடயம் தொடர்பில் முல்லைத்தீவு மாவட்ட மாகாண சபை உறுப்பினர்களான அன்டனி ஜெயநாதன் மற்றும் து.ரவிகரன் ஆகியோர் கருத்துத் தெரிவிக்கையில், எதிர்வரும் 9 ஆம் திகதி மாகாண சபையில் காணி தொடர்பிலான விசேட அமர்வு நடைபெறவுள்ள நிலையில், நாம் தொடர்ச்சியாக நில சுவீகரிப்பு தொடர்பாக தகவல்களை சேகரித்து வருகின்றோம் .

எனவே முல்லைத்தீவு மாவட்டத்தில் எல்லைக் கிராமங்கள் தொடக்கம் 5 பிரதேச செயலர் பிரிவுகளிலும் மக்களுடைய நிலங்களை சுவீகரிக்கும் நடவடிக்கையும் ஆக்கிரமிக்கும் நடவடிக்கையும் வழங்கப்பட்ட காணிகளை திரும்பப் பெறும் நடவடிக்கையும் தொடர்கின்றது. எனவே இந்தத் தகவ ல்களை முழுமையான தரவுகளுடன் சமர்ப்பிக்கவுள்ளோம் என்றனர்.

இதேவேளை யாழ்.மாவட்டத்தில் திரட்டப்பட்டிருக்கும் நிலம் தொடர்பான தகவல்கள் குறித்து மாகாண சபை உறுப்பினர் பா.கஜதீபன் தகவல் தருகையில், வலிகாமம் வடக்கு, வலிமேற்கு, வலிதென்மேற்கு, அச்சுவேலி, எழுதுமட்டுவாள், வடமராட்சி கிழக்கு ஆகிய பகுதிகளில் மக்களுடைய நிலங்களை சுவீகரிப்பதற்கான முயற்சிகள் மேற்கொள்ளப்படுகின்றன.

இவை படையினர், கடற்படையினர் ஆகியோரின் தேவைகளுக்காகவே சுவீகரிக்கப்படவுள்ளதாக சுவீகரிப்பு தொடர்பான பிரசுரத்தில் சுட்டிக்காட்டப்படுகின்றது. இதனடிப்படையில் வலி. வடக்கில் 6381 ஏக்கர், வடமராட்சி கிழக்கில் 700 ஏக்கர். இதில் 250 ஏக்கர் வரையிலான நிலம் கிளிநொச்சி மாவட்டத்திற்குள் வருகின்றது.

இதனடிப்படையில் மொத்தமாக யாழ்.குடாநாட்டில் 7,167 ஏக்கர் நிலம் சுவீகரிக்கப்படவுள்ளதாக முதற்கட்ட தகவல்கள் மூலம் தெரியவருகின்றது. மேலும் தகவல்களை திரட்டி வருவதுடன், நிலத்திற்குச் சொந்தமான மக்கள் மற்றும் தமிழ்த் தேசியக் கூட்டமைப்பினர் மற்றும் தமிழ்த் தேசிய மக்கள் முன்னணியினர் ஆகியோரின் எதிர்ப்பினால், எங்கள் மக்களுக்குச் சொந்தமான நிலத்தை பாதுகாத்து வருகின்றோம் என்றார்.

இதேவேளை கிளிநொச்சி மாவட்டத்தின் நில அபகரிப்பு தொடர்பாக மாகாண சபை உறுப்பினர் பசுபதிப்பிள்ளையுடன் தொடர்பு கொண்டு கேட்டபோது, கிளிநொச்சி மாவட்டத்தில் மொத்தமாக படையினரின் கட்டுப்பாட்டின் கீழ் 5 ஆயிரம் ஏக்கர் நிலம் உள்ளது.

 அன்புபுரம் பகுதியில் 2 ஆயிரம் ஏக்கர், மன்னார் வீதியில் ஆயிரம் ஏக்கர் என மொத்தமாக கிளிநொச்சி மாவட்டத்தில் மட்டும் சுமார் 8 ஆயிரம் ஏக்கர் நிலம் எடுக்கப்பட்டுள்ளது. இவற்றை விடவும் உதிரிகளாக எடுக்கப்பட்டுள்ள நிலங்கள் தொடர்பிலான தகவல்களை சேகரித்து வருகின்றோம். அவற்றையும் மாகாண சபையில் சமர்ப்பிப்போம்.

Chennai: Global Tamil Forum spokesperson and its director of strategic initiatives, Suren Surendiran, presently in Chennai on a private visit, speaks about the Sri Lankan Tamils gaining new hope from change of regime in Delhi.

Excerpts:

Q: The TNA recently met Indian PM Narendra Modi. How do you view this development?

Suren Surendiran: Global Tamil Forum (GTF) believes that Mr Modi meeting TNA members, who are the democratically elected representatives of Tamils in Sri Lanka, is a significant step. On the day after his taking charge as PM, Mr Modi had met President Rajapaksa, who was an invited guest at his inauguration event. However, before meeting a formal Sri Lanka’s government delegation or the official opposition party in Sri Lankan Parliament, PM Modi choosing to meet the TNA underscores the significance.

Regarding subsequent events, Rajapaksa has maintained status quo. He has not made any efforts to engage the TNA in any constructive way. The large military presence still continues in the Tamil-dominated north and east. Land-grabbing and government-sponsored colonisation of the Tamil areas with the clear intent to change the demography is still continuing. Vulnerable women, mostly the 80,000 or more Tamil war widows in the north and east, are being harassed and subjected to sexual violence, largely by the Sinhala military.

Q: What will the efforts towards success in the Sri Lankan Tamil issue look like, say about 18 months from now? And what would be the impact if these efforts fail to yield fruit?

Suren: The Indian foreign policy towards Sri Lanka corrects its course and takes more of a regional leadership role than being the subdued equal partner role. In this process, India uses all levers at her disposal with specific timelines set to achieve lasting peace in the region. India and the international community maintain pressure on Rajapaksa to deliver on his promises and articulate consequences for non-delivery.

Tamil leadership in the north/east and around the country, including the plantation workers and the leadership of the Tamil-speaking Muslims should find convergence on the important issues faced by their communities. The same should be achieved with the like-minded Sinhala Buddhists and Christians. While Tamil diaspora is accepted as a stakeholder by most of the international community, India’s recognition will be fundamentally important to strengthen the moderate voices within the diaspora. This, in turn, will broaden the stakeholder base that can add capacity and capability to the struggle, in the most constructive way.

Failure would mean that Rajapaksa continues as the hawkish President with a corrupt regime persecuting minorities. Allowing this would create rebellious forces from several communities and that will not just destabilise Sri Lanka but the entire region.

Q: LTTE chief Velupillai Prabhakaran was the sole voice representing the Tamil people of Sri Lanka until his death in May 2009. Now the Tamil voice not only sounds weak but also is badly divided.

Suren: The TNA, the elected representatives of the Tamil people in the island, and the GTF that is an umbrella body in the diaspora with significant influence and contacts with several international bodies and governments, work in conjunction. There has been a programme run by the several representative bodies to consolidate even further, which work is in progress. TNA has also taken steps to explore possibilities of convergence with the leadership of Tamil-speaking Muslims in the island. I am more positive about my community than less!

Q: Should the Tamils continue to insist on separate Eelam or work towards something that might be more realistic in achieving, such as the 13th Amendment as a starting point?

Suren: GTF is committed to non-violence. We seek lasting peace in Sri Lanka, based on justice, reconciliation and negotiated political settlement within an undivided island of Sri Lanka.

Q: Considering the Chinese interest and involvement in Sri Lanka, what, according to you, should be the Indian agenda in the strategically important southern neighbour?

Suren: India should at least now, take a regional leadership role to assert her policy on strategic and national security priorities. The lack of it may leave India a larger and unnecessarily wider issue to deal with in the near future.

The Tamil United Liberation Front (TULF) Secretary General V. Anadansangaree in a letter to Indian Prime Minister Narendra Modi this week said the TNA and the ITAK by supporting the activities of the LTTE should take responsibility for innumerable crimes that had resulted in the deaths of thousands.

“Innumerable crimes had been committed resulting in the death of thousands, some of whom were Members of Parliament. According to the TNA’s manifesto of 2004, the TNA and ITAK should accept responsibility for these crimes,” Mr. Anandasangaree said in the letter.

In reference to the TNA’s relationship with the LTTE , Mr. Anandasangaree alleged that ahead of the 2004 Parliamentary elections, representatives of the ITAK, ACTC, TELO and the EPRLF signed a declaration accepting the “leadership of the LTTE as the National Leadership of the Tamil people and also accepting the LTTE as the real sole representatives of the Tamil people.” They also pledged “to give our full support for the struggle the LTTE had undertaken on behalf of the Tamil Nation”.

He said the declaration of the four secretaries of the alliance gave ample opportunities for the LTTE to commit atrocious crimes between April 2004 and May 18, 2009. The TULF General Secretary urged the Indian Prime Minister to consult other Tamil political parties and Tamil-speaking people of Sri Lanka and not exclusively the Tamil National Alliance (TNA).

“Dealing with the Tamil question is no more a monopoly of either the TNA or the Illankai Tamil Arasu Kachchi (ITAK). Having waited so long by allowing the TNA to deal with our ethnic problem and having lost confidence in the TNA, the time has now come for all the other concerned parties to find an alternative,” V. Anandasangaree said in a letter to Mr. Modi this week.

Mr. Anandasangaree said the TNA was supposed to comprise five political parties — the ITAK, TELO, EPRLF, TULF and the PLOTE – but the delegation which met Modi comprised only four members from the ITAK and one each from the TELO and EPRLF with none from the PLOTE although its leader polled more than 40,000 votes and came third at the recently held Northern Provincial Council elections.

He added that the claim of the TNA that voters had repeatedly given it the mandate through various elections, to negotiate with the Government was not acceptable and misleading. “The 2004 general election was virtually conducted by the LTTE with little or no supervision by the Government. There was large scale impersonation, threats and intimidation of voters by the LTTE and some won after their defeats were announced.”

Mr. Anandasangaree said the Indian Prime Minister’s advice must be taken seriously if the Tamils in Sri Lanka wanted a solution. “Hence action should be taken forthwith to consult various political parties of Tamils and Tamil-speaking people to know their views. The intention of meeting the party leaders is not to confront any one of them including the TNA and the ITAK, who should be warned of their links with the LTTE if they are serious in finding solutions. The sole purpose is to arrive at a consensus and to see to what extent we can compromise,” he said.

US Now Admits it is Funding “Occupy Central” in Hong Kong

Just as the US admitted shortly after the so-called “Arab Spring” began spreading chaos across the Middle East that it had fully funded, trained, and equipped both mob leaders and heavily armed terrorists years in advance, it is now admitted that the US State Department through a myriad of organizations and NGOs is behind the so-called “Occupy Central” protests in Hong Kong.

The Washington Post would report in an article titled, “Hong Kong erupts even as China tightens screws on civil society,” that:

Chinese leaders unnerved by protests elsewhere this year have been steadily tightening controls over civic organizations on the mainland suspected of carrying out the work of foreign powers.

The campaign aims to insulate China from subversive Western ideas such as democracy and freedom of expression, and from the influence, specifically, of U.S. groups that may be trying to promote those values here, experts say. That campaign is long-standing, but it has been prosecuted with renewed vigor under President Xi Jinping, especially after the overthrow of Ukrainian President Viktor Yanukovych following months of street demonstrations in Kiev that were viewed here as explicitly backed by the West.

The Washington Post would also report (emphasis added):

One foreign policy expert, who spoke on the condition of anonymity to discuss a sensitive subject, said Putin had called Xi to share his concern about the West’s role in Ukraine. Those concerns appear to have filtered down into conversations held over cups of tea in China, according to civil society group members.

“They are very concerned about Color Revolutions, they are very concerned about what is going on in Ukraine,” said the international NGO manager, whose organization is partly financed by the National Endowment for Democracy (NED), blamed here for supporting the protests in Kiev’s central Maidan square. “They say, ‘Your money is coming from the same people. Clearly you want to overthrow China.’ ”

Congressionally funded with the explicit goal of promoting democracy abroad, NED has long been viewed with suspicion or hostility by the authorities here. But the net of suspicion has widened to encompass such U.S. groups as the Ford Foundation, the International Republican Institute, the Carter Center and the Asia Foundation.

Of course, NED and its many subsidiaries including the International Republican Institute and the National Democratic Institute do no such thing as “promoting democracy,” and instead are in the business of constructing a global network of neo-imperial administration termed “civil society” that interlocks with the West’s many so-called “international institutions” which in turn  are completely controlled by interests in Washington, upon Wall Street, and in the cities of London and Brussels.

The very concept of the United States ”promoting democracy” is scandalous when considering it is embroiled in an invasive global surveillance scandal, guilty of persecuting one unpopular war after another around the planet against the will of its own people and based on verified lies, and brutalizing and abusing its own citizens at home with militarized police cracking down on civilians in towns like Ferguson, Missouri – making China’s police actions against “Occupy Central” protesters pale in comparison. “Promoting democracy” is clearly cover for simply expanding its hegemonic agenda far beyond its borders and at the expense of national sovereignty for all subjected to it, including Americans themselves.

In 2011, similar revelations were made public of the US’ meddling in the so-called “Arab Spring” when the New York Times would report in an article titled, “U.S. Groups Helped Nurture Arab Uprisings,” that:

A number of the groups and individuals directly involved in the revolts and reforms sweeping the region, including the April 6 Youth Movement in Egypt, the Bahrain Center for Human Rights and grass-roots activists like Entsar Qadhi, a youth leader in Yemen, received training and financing from groups like the International Republican Institute, the National Democratic Institute and Freedom House, a nonprofit human rights organization based in Washington.

The article would also add, regarding NED specifically, that:

The Republican and Democratic institutes are loosely affiliated with the Republican and Democratic Parties. They were created by Congress and are financed through the National Endowment for Democracy, which was set up in 1983 to channel grants for promoting democracy in developing nations. The National Endowment receives about $100 million annually from Congress. Freedom House also gets the bulk of its money from the American government, mainly from the State Department.

“Occupy Central” is one of many waves that have hit China’s shores since.

Pro-war and interventionist US Senator John McCain had famously taunted both Russia’s President Vladimir Putin and President Xi Jinping’s predecessor in 2011 that the US subversion sweeping the Middle East was soon headed toward Moscow and Beijing. The Atlantic in a 2011 article titled, “The Arab Spring: ‘A Virus That Will Attack Moscow and Beijing’,” would report that:

He [McCain] said, “A year ago, Ben-Ali and Gaddafi were not in power. Assad won’t be in power this time next year. This Arab Spring is a virus that will attack Moscow and Beijing.” McCain then walked off the stage.

Considering the overt foreign-funded nature of not only the “Arab Spring,” but now “Occupy Central,” and considering the chaos, death, destabilization, and collapse suffered by victims of previous US subversion, “Occupy Central” can be painted in a new light – a mob of dupes being used to destroy their own home – all while abusing the principles of “democracy” behind which is couched an insidious, diametrically opposed foreign imposed tyranny driven by immense, global spanning corporate-financier interests that fear and actively destroy competition. In particular, this global hegemon seeks to suppress the reemergence of Russia as a global power, and prevent the rise of China itself upon the world’s stage.

The regressive agenda of “Occupy Central’s” US-backed leadership, and their shameless exploitation of the good intentions of the many young people ensnared by their gimmicks, poses a threat in reality every bit as dangerous as the “threat” they claim Beijing poses to the island of Hong Kong and its people. Hopefully the people of China, and the many people around the world looking on as “Occupy Central” unfolds, will realize this foreign-driven gambit and stop it before it exacts the heavy toll it has on nations that have fallen victim to it before – Libya, Syria, Ukraine, Egypt, and many others.
